SNOW STORAGE EASEMENT AGREEMENT
THIS SNOW STORAGE EASEMENT AGREEMENT ("Agreement")is entered into
effectiveas of dæ |(pft ,2021 by and between Mike Acuff ("Acuff"or
"Grantor")of 4()7Ryan Drive,Bozeman,MT 59715 and RB53,LLC,("RR53"or "Grantee")
a Montana limitedliabilitycompany of510 W.Hemlock,Bozeman,MT 59715.
WHEREAS,Acuff owns realestatecommonly referredto as 341 GallatinPark Drive,
Bozeman,Montana and legallydescribedas ibliows:
Lot 5 in Block I of GallatinPark Subdivision,locatedin the NEl/4 and SE1/4 of
Section36,Township 1 South,Range 5 East,P.M.M.,GallatinCounty,Montana,
according totheoflicialplatthereofon fileand of record inthe ofTiceof the Clerk
and Recorder,GallatinCounty,Montana.[Deed Reference:2416223]
("Acuff'sProperty"or "ServientEstate")
WHEREAS,RB53 owns realestatecommonly referredto as 325 GallatinPark Drive,
Bozeman,Montana and legallydescribedas follows:
Lot 4A,Block I of the Amended Platof Lots 3 and 4 Block I of GallatinPark
Subdivision,City of Bozeman,GallatinCounty,Montana according totheollicial
platthereofon fileand of record intheofficeof the Clerk and Recorder,Gallatin
County,Montana.[Deed Referenec:2700423]
("RB53 Property"or "Dominant Estate")
WHEREAS,RB53 desiresto obtain from Acuff,and Acuff agrees .togrant to RB53,a
permanent snow storagecasement over and across Acuirs Property within the Snow Storage
Easement Area (delinedbelow)accordingto the terms and conditionssetforthherein.
NOW THEREFORE,for One Dollar and other good and valuable consideration,the
receiptand sufficiencyof which are hereby acknowledged,the partiesagree as Ibliows:

1.AculT hereby grants and conveys to RB53 a non-exclusive easement (the
"Easement"),over,upon and across that podion of Acuirs Property as it borders RB53's
Property and as Ihrtherdetailedand describedon ExhibitA attachedhereto(the"Snow Storage
Easement Area")íbrthe storageof snow and access toand maintenance of the same.As partof
thisBasement,Grantee shallbe allowed to depositand storesnow from itspropertywithin the
Snow Storage Easement Area on AcufTs Property.AcufThereby grantsRB53 access to and from
Acuff's Property within the Snow Storage Easement Area as may be reasonably necessary to
push,blow,shovel,or otherwisedepositthesnow from RB53's Propertywithin the Snow Storage
Easement Area.While utilizingEasement,Grantee shallcause as littledamage as possibletothe
Servient Estate,and shallpromptly repairany damage caused by itsuse of the Snow Storage
Easement Area and shallrernoveany garbage or debristhatmay be Icítwhen the snow melts.
2.Said Easement granted from AcuíTto RB53 isnon-exclusiveand the Snow Storage
Easement Area may be used by AcuiT so long as said use is not adverse to RB53's use of the
Snow Storage Easement Area.Notwithstanding anything to the contraryherein,Grantor retains
the rightto utilizethat portion of the Servient Estatewhich issubjectto thisEasement fbr all
purposes as do not have an adverse effecton Grantee'sabilityto access and storesnow withinthe
Snow Storage Easement Area.
3.The Easement shallbe perpetualand shallrun with the land,for the bencût of
RB53 and itsagents,successorsand assigns,subjectto theterms and conditionssetihrthherein.
4.The scope of the Easement shallbe íbr access to and from and the use of the
Snow Storage Area forsnow storageand uses incidentalthereto.The Grantee may develop and
furthersubdivide itspropertyand such development and/or subdivisionshallnot be considered
an overburdening of theEasement.
5.In theevent of a disputeover thisEasement Agreement,the partiesagree thatthe
prevailingpartyinany legalproceeding to enforceor interpretthisEasement Agreement shallbe
entitledto recoverthe costsof such lawsuit,includingreasonableattorney'sfees,from the other
party.
6.Time isof theessence with respectto the provisionsof thisAgreement.
7.This Agreement shall in all respectsbe interpreted,construed and enforced
according to the laws of the Stateof Montana.Ifany term of thisEasement Agreement is fbund
to be void or invalid,such invalidityshallnot affectthe remaining terms of this Easement
Agreement,which shallc(mtinue in fullIbrec and effect.This Easement Agreement may be
executed in one or more counterparts,which taken together shallconstituteone and the same
document.
8.Whenever requiredby the contextof thisAgreement,any singularreferenceshall
includethe pluralreference,and any pluralreferenceshallincludethe singular.

9.Nothing contained in thisAgreement shallor shallbe deemed to constitutea giil
or dedicationof any portionof the Snow Stontge Easement Arca to the general public,forthe
benefitof the general public,or forany public purpose whatsoever,itbeing the intentionof the
partiesheretothatthecasement createdhereunder shallbe strictlylimitedtoand forthe purposes
expressed herein.The partiesagree and acknowledge that,except as expresslysetforthherein,
there are no intended third-partybeneficiariesof thisAgreement or of any of the rightsand
privilegesconferredherein.
10.Such Easement isand shallbe deemed to be a covenant running with the land and
shallbe binding upon the partiesheretoand upon theirsuccessorsand assigns.Any modification
or amendment shallbe effectiveonly when duly executed,acknowledged and filedintheproper
ofliceof theClerk and Recorder of GallatinCounty,Montana.
I1.The failureof eitherparty to take action with respectto any breach of any term,
covenant,or conditioncontainedin thisEasement Agreement shallnot be deemed to be a waiver
of such term,covenant,or condition or subsequent breach of the same,or any other term,
covenant,or conditioncontained in thisEasement Agreement,unless such waiver isin writing
and signed by theparties.
12.Grantor hereby warrantsand representsto Grantee thatthe holdersof allrecorded,
pre-existingmortgages,Deeds of Trust and any otherlienaffectingthe ServientEstateconsent to
the grantingof thisEasement and subordinatetherightsto the Easement.Grantor representsand
warrants thatthe granting of thisEasement does not constitutean event of defaultunder any
mortgage,Deed ofTrust,or any otherlienaffectingthe ServientEstate.
