REFUSE ENCLOSURE EASEMENT
THIS REFUSE ENCLOSURE EASEMENT is entered into effective as of
.EM_____,202 I by and between Mike Acuff ("Acuff"or "Grantor")of 407
Ryan Drive,Bozeman,MT 59715 and RB53,LLC,("RB53"or "Grantee")a Montana limited
liabilitycompany of 510 W.Hemlock,Bozeman,MT 59715.
WHEREAS,Acuff owns realestatecommonly referredto as 341 GallatinPark Drive,
Bozeman,Montana and legallydescribedas follows:
Lot 5 in Block I of GallatinPark Subdivision,locatedin the NEl /4 and SEl/4 of
Section36,Township 1 South,Range 5 East,P.M.M.,GallatinCounty,Montana,
according totheollicialplatthereofon fileand of record inthe olliceof the Clerk
and Recorder,GallatinCounty,Montana.[Deed Reference:2416223]
("Acuff'sProperty"or "ServientEstate")
WHEREAS,RB53 owns realestatecommonly referredto as 325 GallatinPark Drive,
Bozeman,Montana and legallydescribedas follows:
Lot 4A,Block I of the Amended Platof Lots 3 and 4 Block I of GallatinPark
Subdivision,City of Bozeman,GallatinCounty,Montana according tothe official
platthereofon fileand of record in the officeof the Clerk and Reconfer,Gallatin
County,Montana.]Deed Reference:2700423]
("RR53 Property"or "Dominant Estate")
WHEREAS,RB53 desiresto obtain from Acuff,and Acuff agrees to grantto RB53,a
permanent refuse enclosure casement over and across Acuffs Property within the Refuse
Easement Area (definedbelow)according tothe terms and conditionssetforthherein.
NOW THEREFORE,for One Dollar and other good and valuable consideration,the
receiptand sufficiencyof which arehereby acknowledged,the partiesagree as follows:

1.AculT hereby grants and conveys to RB53 an easement (the "Easement"),over,
upon and acrossthatportionof Acu1Ps Property as furtherdetailedand describedon Exhibit A
attachedhereto(the"Refhse Eaxement Area")forthe placement of a trashenclosureand storage
of trashcontainersfortrash,as well as access to and maintenance of the same.As partof this
Easement,Grantee shallbe allowed tobuilda trash/refuseenclosureand phtce trashc(mtainersfbr
trashwithinthe Refuse Easement Area on AcuíPs Property.AcufThereby grantsRB53 and its
agents,assignsand contractorsaccess to and from AcutPs Propertywithin the Refuse Easement
Area as may be reasonablynecessaryto build,repair,replaceand maintainthetrashenclosure,as
well as to place containersand trashwithin the containersand tbr the removal/emptying of the
trashcontainers.While utilizingthe Easement,Grantee shallcause as littledamage as possibicto
the Servient Estate,and shallpromptly repair any damage caused by itsuse of the Refuse
Basement Area and shallpickup and remove any garbage or debris that may fallout of the
containersand/ortrashenclosure.
2.The Easement shallbe perpetualand shallrun with the land,forthe benefitof
RB53 and itsagents,successorsand assigns,subjectto the terms and conditionssetforthherein.
3.The scope of the Easement shallbe fbr access to and from and the use of the
Refuse Easement Area for a trash enclosure,storageor trashcontainers,trashcollectionand
trashremoval and uses incidentalthereto.The Grantee may develop and furthersubdivide its
propertyand such development and/or subdivisionshallnot be considered an overburdening of
the Easement.
4.In theevent of a disputeover thisEasement Agreement,the partiesagree thatthe
prevailingpartyinany legalproceeding to enfbree or interpretthisEasement Agreement shallbe
entitledto recoverthe costsof such lawsuit,includingreasonableattomey's fees,from the other
party.
5.This Agreement shall in all respects,be interpreted,construed and enforced
according to thelaws of the Stateof Montana.Ifany term of thisEasement Agreement isfbund
to be void or invalid,such invalidityshallnot affectthe remaining terms of thisEasement
Agreement,which shallcontinue.in fullihree and effect.This Easement Agreement may be
executed in one or more counterparts,which taken togethershallconstituteone and the same
document.
6.Whenever requiredby the contextof thisAgreement,any singularreferenceshall
includethepluralreference,and any pluralretbrenceshallincludethe singular.
7.Nothing contained in thisAgreement shallor shallbe deemed to constitutea gift
or dedicationof any portionof the Refuse Easement Area to thegenend public,tbrthebenefitof
the general public,or for any public purpose whatsoever,itbeing the intentionof the parties
hereto that the easement created hereunder shallbe strictlylimitedto and fbr the purposes
expressed herein.The partiesagree and acknowledge that,except as expresslysetforthherein,
there are no intended third-partybeneficiariesof this Agreement or of any of the rightsand
privilegesconferredherein.

8.Such Easement isand shallbe deemed to he a covenant running with the land and
shallbe binding upon thepartiesheretoand upon theirsuccessorsand assigns.Any modification
or amendment shallbe e1Tectiveonly when duly executed,acknowledged and filedin the onice
of theClerk and Recorder of GallatinCounty,Montana.
9.The failureof eitherparty to take actionwith respectto any breach of any term,
covenant,or conditioncontainedinthisEasement Agreement shallnot be deemed tobe a waiver
of such term,covenant,or condition or subsequent breach of the same,or any other term,
covenant,or c(mditioncontained in thisEasement Agreement,unless such waiver isin writing
and signed by theparties.
10.Grantor hereby warnmts and representsto Grantee thatthe holdersof allrecorded,
pre-existingmortgages,Deeds of Trust and any otherlienaffectingthe ServientEstateconsent to
the gnintingof thisEasement and subordinatethe rightsto the Easement.Gnmtor representsand
warnmts thatthe granting of thisEasement does not constitutean event of defaultunder any
mortgage,Deed of Trust,or any otherlienaffectingtheServientEstate.
