Dear Mr. Gaston:
The above referenced plans and specifications have been reviewed
by engineers of the Environmental Sciences Division and were
found to be satisfactory. Approval, of these plans is given
herewith and according to the following provisions :
That any change in the above referenced plans will. be submitted
to the Water Quality Bureau for review prior to the beginning of
construction, and,
That within 90 days after project construction, the engineer
shall certify to the department that the project was completed in
accordance with the plans and specifications approved by the
department . This certification shall be accompanied by a
complete set of "as built " drawings signed by the project
engineer, and,
That departure from any criteria set forth in the approved plans
and specifications without department approval is grounds for
injunction by the Department of Health and Environmental-
Sciences .

r checked. with OHES regarding the required testing needed on
Lyman Creek water . Mr . Jim Melstad stated that the new regulations
would be out in a month or two and that we should wait .
He did , however , mention that once the new safe drinking water-
regulations are out in final form any community having a surface
water source such as Lyman Creek will be given 18 months Wst ) to
prove to the DHSS why filtration is not needed . It this is the
case , I think that a testing program such as outlined in my letter
of February 17 , 1988 would be a good idea to initiate now.
Once the new improvements are installed , we will be monitoring tur-
bidity continually; pH and temperature are no big thine and can be
obtained during t;he daily visit , The only real cost would be coli-
form which is a good idea anyway.
Jim Melstad said he would keep nee posted as to the final
requirements and let me know of any change in sampling .

In response to your conversation with Mr. Steve Baer, Gundl,e
can certify that; our HDPE liner can meet the properties an.
questions:
1 . Melt Index Value of . 1 to .2; g/10 min. 0r . 3 g/10 min.
MAXIMUM, instead of . 5 to 1. 1 g/10 rein.. as specified. A
lower melt index is better for HDP1. ,Liners because it
means a higher molecular chain it$ Composition. A higher
molecular chain provide's a greater resistance to
p011k1ta,nts that may break down the linen.
2 . A carbon }slack dispersion of as A-1, A-21 or B-1 range
instead of A--1. The oa'rbon black dispersion testing is
very subjective, and it is al.Most impossible to obtain an
A-1 level of dispersion. consistentl.y, Gundl,e' s dispersion
range of A-1, A-2, or B-1. is eXcepted in the hazardous
waste industries by such campa11.Jes as Chemical Waste
Management, Inc.
3 . A sea& shear strength of 90% and peel value of 50% of
parent sheets tensile yield value instead of 100% for
sho4r and 80% for peel . When: welds are tested in peel and
shear, they will never exhibit tensile strength values as
high as the parent sheet.. The overlap of the sheets at
the -weld prevel-its the Sample from being stressed in a
single plarle and the angle of the samples endures
additional bending stress in the material. In peel, tests,
the induced bending stresses are even higher than in an
shear test.
4 , A low temperature brittleness of --440C max. instead of
7000. Even though Gundle is confident that the liner will
withstand eXtreme temperature, it is impossible for the
testing machiTie to give accurate results at such low
temperatures.

6. A 7. 6cm minimum overlap of the owhot wedge,, seam weld
itstead of 12 cm. Due to the configuration of the wedge
welding machine and the tendency of the two liners to
separate as the machine passes over the two liners to he
seamed, a 7 . 6 cm or 3 inch minimum overlap is obtoi„nable.
TIlis should fully explain Giandle certification capacity for the,
tests in giiestions, and 1 hope it will answer any question;
that you have concerning our HDPF liners.

The enclosed Statement of Compliance by Nelson , Inc . for work done
on Lyman Creek water system improvements for the weeks of 4-20-89 ,
5 -5-89 , 5 -1I -89 , 5 -17 -89 , 5 -26 -89 , 6-2 -89 , and 6-9 -89 have been
reviewed by our office and found to be satisfactory .
Nelcon , Inc . is paying the standard prevailing rate of wages
including fringe benefits and is complying with MCA Section
18-2 -403 , preference of Montana Labor 'in Public Works , providing
for giving preferences to the employment of bona Fide Montana
residents . The amount of hours worked per week by employees 'is
also correct .
When additional Statement of Compliance has been received by
Gaston Engineering & Surveying , we shall review them and send them
to your office .

Enclosed Please find a copy of a letter from Gundle regarding
their arrangements with Columbia Rese-rvoir System Ltd . rt appears
this question of "what and who " will be doing the reservoir cover
has finally been answered . Also Please note , I have received
drawings from Gundle regarding the floating cover and have given
a set to Ron Portnel . I will be getting a schedule from Gundle
regarding assembly of the cover and will forward a copy to your
office .
As You know , we have finished pioneering the road to the spring
and have completed the spring excavation . At the present time the
spring source remains uncovered because of our excavation . The
water Supply has stabilzed and we are in the process of measuring
th spring quantity . It appears that a rectangular weir will suf -
fice in indentifying the flow . By next week my schedule is to
have a portable weir constructed and installed at the spring site .
Although there are not large rainbow trout at the spring , you may
want to accompany us on one or two of the trips ,
We are well ahead of ( less than ) the budget figures I gave you
regarding to spring investigation . Costs 'for step one and two
( pioneer road and spring excavation ) will be included in this next
Pay estimate as a change order . And , yes , Your assumption that
the price I quoted for our -services was to replace the cost deve -
loped in 1986 for this work .
Will keep You posted as to our progress and proposed schedule for
Lyman Creek Spring .

i The 1989 Montana Legislature has approved a loan authority of
$ 386 , 893 . 00 for your water system project .
The Department will be able to provide .loan funds during the
Current constructiQn season and iS acc rding,�y scheduling the
sale of State of Montana Coat, Severance Tax Bonds in September
1,989 and 1990 . Our underwriter has also told us that interest
rates will, most likely be close to the seven percent we
anticipated in the application . In order to establish the size
of the state issues , the Department needs a resolution of intent
to issue a bond for sale to the Department from each project
sponsor and a preliminary budget which includes the non-construct:-
ion casts and a contingency amount to cover unexpected cost
fluctuations . Project sponsors should submit resolutions of
intent: and a preliminary budget: before they plan to begin their
projects .

A model resolution of intent is enclosed as well as a budget form.
The resolution of intent is our assurance that you understand the
terms of the loan and the costs involved and are intending to
complete the steps necessary to issue a local bond to finance
the project . The budget will probably not differ too much from
the one submitted with your application but you will want to make
a few changes . We have included two attorneys as budget Stems ,
The local attorney will be needed if you purchase land or
negotiate easements for your project . You may choose to use an
attorney if you anticipate PSC proceedings for a rate increase .
We have also listed a band attorney in the event one is required
i and suggest that you budget $1. , 000 . 00 for local, attorney fees ,
$2 , 500 . 00 for a bond attorney. The budget should include three
( 3 ) percent for issuance costs . The issuance costs should be
on the amount in the loan column . You should also include in the
budget an amount for the reserve requirement you expect to fund
from bond proceeds . The reserve is one semi-annual payment and, can

be funded completely with rates over a three-year period or
completely or partially from proceeds . The Reserve amount should
also be based only on the amount in the loan column. You may elim-
inate the inflation contingency if you plan to construct this year
or feel your costs will hold through the anticipated construction
period . The construction contingency can be a percentage of the
lump sum construction cost or different for each construction line
item. Please indicate the method you choose on the budget form.
Try to come as close as you can to a complete cost estimate. if
the project has been or will be reduced ill scope, the reduction
must not affect priority activities . The budget form should be
signed by the Mayor and the Project Engineer if one is under
contract . Please be sure to indicate in the space provided
on the budget form if you plan to borrow the grant amount .
The Department disburses loan funds as a lump sum when the bond
has been issued and the purchase documents signed by the sponsor
and the Department . The purchase transaction takes place when
the construction contracts are signed. in some cases the
construction contracts can be submitted a short time after bond
closini, :pith Department permission. Water and sewer p+lans and
specifications must be approved by the Department of Health and
Environmental Sciences as well as the Department of Natural
Resources and Conservation. An amortization schedule to help
you determine rates needed to amortize the loan has been included.
We have been conservative and used an eight ( 8 ) percent interest
rate for the schedules . If you have an outstanding bond, you
should review that bond resolution as to the coverage requirements .
Most require that annual net: revenues (gross revenues less operating
costs ) yield 125% of the maximum annual debt: service requirements
of all outstanding bonds . If there are no outstanding bonds
secured with rates frorn your system, annual revenues for debt
service must yield 125% of the maximum annual debt service plus
the reserve amount yoil plan to fund from the rates .
We will be happy to help you in any way we can and plan to meet
with all our loan sponsors this summer to review the bond purchase
procedures .

RESOLUTION OF INTENT TO FINANCE WATER SYSTEM IMPROVEMENTS
BY THE ISSUANCE AND SAFE OF BONDS
WHEREAS , the City of Bozeman intends to
authorize the issuance_ of bonds to finance the water system
improvements ( the Project ) ; and
WHEREAS, the City of Bozeman intends to undertake with
due diligence, a-ny required rate proceedings with the Public Service
Commission ; and
WHEREAS , in 1989 Montana Legislature in HB 718 authorized the
Montana Department of Natural Resources and Conservation ( the DNRC)
to make a loan to the City of Bozeman of up to
$ 386 , 893 . 00 at the interest rate which the state bond is sold
with a subsidy of two ( 2 ) percent for the first five ( 5 ) years of an
anticipated 20-year term and must be at the rate which the state band
is sold for the remaining 1.5 ,years ; and
WHEREAS , the DNRC has informed the City of Sozeman
that it will make the loan authorized by the 1989 Montana Legislature
by purchasing bonds from the City of Bozeman in the
amount of the loan , and that it will charge the
City of Bozeman an origination fee of approximately
three ( 3 ) percent ; and
WHEREAS , this Council has reviewed the attached budget for the
Project and is satisfied that the estimates contained therein are
reasonable and that all anticipated Project costs are included;
WHEREAS , the City of Bozeman expects to begin
construction of the project on or about _ and
complete the project on or about an
WHEREAS , the City of Bozeman agrees to complete
necessary steps to acquire these funds as described in the Water
Development Reports , January , 1989 , and in HB 788 , both of which
have been provided by the Department ; and

of the Project provided that such bonds be sold at a private sale to
the State of Montana , notwithstanding the fact the legislature has
authorized the DNRC to purchase the bonds ;
NOW, THEREFORE, BE IT RESOLVED by the City of Bozeman
as follows :
1 . This Council. hereby declares its intention
to authorize the issuance of a Revenue Borid , in an amount
estimated not to exceed $ 386 , 893 . 00 bearing interest
at the rate for which the state bond is sold and with a
subsidy of two ( 2 ) percent for the first five ( 5 ) years of an
anticipated 20-year term and must be at the rate which the
state bond is sold for the remaining 15 years . To finance
the construction of the Project the sale of such bonds shall
be conducted in accordance with the applicable state statutes .
2 . The City air Bozeman declares
its intention to levy rates necessary to repay
the loan and to seek approval of the Montana Public Service
Cotmiission for the rates if required .
3 . This Council hereby authorizes and directs the
officers of the City of Bozeman to prepare
all documents and to take all steps necessary to
permit. this Cosancil to authorize, issue , and sell such
bonds and levy rages for their repayment. .
4 . This resolution shall become effective immediately
upon its passage and approval .

We have been notified that Gundle ' s main contact person here on
the Bozeman water project , Myron Harris , will be transferred this
Friday (9 /8/89 ) , Please be advised that we are extremely dissa -
tisfied with the job performance of 'the Gundle crew assembling the
floating cover and removing their main contact person now will add
to the problems .
It appears that now that. Myron has become an experienced hand at
this type of project , they are sending him on to a bigger and
better project . Please be advised that we will look extremely
unfavorably on this decision . The project is now under penalty

Dear sirs :
This letter is to inform your company that the City of
Bozeman is requiring a "Maintenance Mond" for a period of
four years commencing upon the expiration of the one year
contractor' s warranty to cover any needed repairs in
workmanship and materials on the floating reservoir cover .
During the final inspection on the floating cover, our
consulting engineer, Gerald Gaston , noticed several leaks at
the interface of the hyplon and HDPE which required sealing
with a non-standard material . in light of this repair method
as well as mis-alignment of several pulley cables and
attachment points , we are requiring either satisfactory
sealing and re--adjustment of pulleys or an additional four
year maintenance bond. This item was discussed at length
by Mr . Gaston with Myron Harris (Gundle ) and his superiors
and was apparently decided by them to be the best approach.
If that decision still stands , please make the bond recipient

& 2 on the above referenced project for your use .
Also, please note that we have operated a.l.l the equipment , pump
and associated appurtenances and find all, itcriis operate as origi-
nally designed. The only item needing calabration now is the
flow meter . I have asked Bill, Haldane to construct a weir for the
new diversion structure . This unit will be used, to measure
available water from the spring. With this data, we can either
determine the amount flowing through the meter by measuring the
difference or simply by using the entire amount available .
As I mentioned to you earlier , we will need the resources of the
city in the form of field personnel who can make the trip to the
new div~ rsion during this period of calibrating the meter .

Tear Bill,
As you know, we tried to fine tune the equi.pinent at Lyman Creek
last week with Jerry Fastmark . It became very obvious that the
flow meter is in error and needs to be calibrated to match the
flows actually found in the line .
After giving this subject much thought and after having some
discussion with Craig Brawner at the city, let me give you my
sugge yti.on as to what will be required . It appears that there is
approximately 350 to 400 gpm originating at the spring requiring a
weir approximately 3 to 12 inches in width . This width will dive
us a good reading ( 3" to 5 " ) in depth over the wear . Once we have
measured the actual flow at the diversion structure , we can
ca.l.ibrate the flow meter . l have talked to the city and they have
agreed to give us some personnel to help measure the flows up at
the diversion structure .
I feel you should get the weir made for insert :.into the overflow
structure and then let me know so I can coordinate with the city.
Also, be advised that the Turbidity meter and the two chlorine
residual monitors will need to be adjusted to match actual con-
ditions . You Will need to make provisions for this item also.

referenced project that all equipment is now functional at the
reservoir site . With the exception of a working alarm light at
the Police Station , everything is complete .

ready for a 24 hour operational test .

We are still trying to get the performance tcut on the above noted
project completed so we can turn the system over to the City of
Bozeman .

are two major items which will need correction before we can

The flow control valve which controls Clow into the
pipeline above the reservoir ;'reeds to be able to drive
shut in case of a power failure . During our run through
this valve did not function as Specified .
The pump control valves at the booster station are
designed to open after the pumps are running and to
close before the pump shut off . During our run through

Glen Stensrud, Engineer Jerry Gaston and the City Engi.neez
Craig Brawner it is requested that the following list be
taken care of as soon as possible tar the above referenced
Project.
1 . NE and NW corner sums need to be cleaned
and re--welded with leaks stopped.
2 . Leaks repaired between Posts 56B and 57 and also
between Posts 4 and S .
3 . Also, it has been requested that an Operation and
Maintenance Manual, be provided by your company.
Please send this manual to the City Engineer,
Craig Browner.
Glen St6nsrud has been in contact with your local.
repre8entative and made him aware of these corrections .
Your immediate attention will be greatly appreciated.

Dear Mr . Nelson ,
I have conducted another field test- inspection on the above noted
project and find the following items still needing correction and
yo�4r attention .
1 . Influent chlorine .residual graph inoperative
2 . affluent chlorine residual graph - starting to become erratic;;
3 . Flouride pump - still leaks oil
a . Flouride mixer Motor starting to vibrate
5 . Inlet flow graph W- drops off line periodically
6 . Boster station electrical relays need to be firmly attached
to clectr:ical panel .
This project punch list seems to keep growing without much atten-
tion to repaira . l would like to get these i.tezns completed before
the city devei,ops a bad attitude about the project and derides to
do something on their own .

Eleventh Month Inspection
Dear Click ,
The eleventh month inspection on the above referenced project was
held can October 17 , 1990 and the following items were noted with
regard to the floating cover on the Lyman Creek Reservoir .
1 , Many of the tension cable assemblies have loose bolts
which have come loose and require re-installation with
washers .
2 . Attachment points for the tension cables on the north--
west corner have pulled ,Loose or are tearing and need
repair . This is the corner that the installers had a
lot of problems with and it looks lake an improper glue
installation .
3 . We still have many areas where ferrous metal chains have
been used . These need to be replaced .
Dick , many of the areas that are tearing, coming loose , or have
rusting metals are areas originally noted . It appears that the
workman have just done a sloppy repair job without consideration
for long term operation .
The future repairs need to be accomplished by competent personnel.

2 . Mixer Motor and. assembly for flouride unit need to be
installed .
3 . Chlorine detector inoperative and needs repair .
4 . Relays in booster station need to be mounted in an
approved electrical box .

We are also in need of an 0 & M information on the floating rover .
The big question is how clueing can be done the field? What
kind of glue? What kind of temperatures? What kind of materials?
We also need some maintenance information .
Tease forward this information to us as soon as possible and let
