The information presented in this supplement together with the application is necessary for the Department to process an application. It is the applicant's responsibility to provide credible, relevant, and factual information upon which the Department may rely to support the issuance of a change authorization. Addressing each item, state facts which show that the criteria are met. Attach additional documentation if necessary. Be as thorough as possible. I. The proposed use will not adversely affect the water rights of other persons or other planned uses or developments for which a permit has been issued or for which water has been reserved. There are no other diversions between the existing pod' s and the new pod' s. The entire prof ct is entirely within^Property owned by the City of Bozeman. The original pod and the 1989-1991 pod will be maintained and used for emergency/backup Purposes only, The primary pod is in the E� 1'3_ of Section 2 II. The proposed means of diversion, construction and operation of the appropriation works are adequate. See attached. III. The proposed use of water is a beneficial use. Two subsurface spring boxes will be constructed at the upper most point of diversion from which the flows will be piped past the historical point of diversion to the City' s current reservoir and water distribution system. The intermediate diversion consists of an in-stream diversion pond which could be used in lieu of the upper diversion during periods of maintenance or repair of the up- per system. Both diversions cannot be used simultaneously due to differences in the elevation head of the supply. In the period since receipt of your letter, certain information has come to my attention which might have some bearing on your statement that all of the waters of Lyman Creek above the City's reservoir are owned ex— clusively by the City of Bozeman". Specifically, I refer to the deed of my neighbors, the William Huffines, in which it is rather clearly stated that they have a permanent ditch right to a ditch which comes off Lyman Creek well above the City's Reservoir. In addition, it is stated that they have rights for a two weeks period each Spring to water in excess of a certain amount as measured at the intake to the City Reservoir. I am sure that you will agree that any inaccurate statements in your letter to me of August loth, if any such exist, should be corrected. I shall forward a copy of this letter to Mr. Ben E. Berg, Jr. , the City Attorney, and ask that you consult with him after he has had an oppor— tunity to review the matter. I would then request that you write to me again, with copies to all parties concerned, with a summary of Mr. Berg's findings. I shall also forward a copy of this letter to Mr. and Mrs. L. MI. Green, my neighbors to the west. It was Mr. Green's suggestion that some consideration be given to the possibility of diverting wate from Lyman Creek. An evaluation of the supply, storage , treatment, and transmission should be a number one priority. A detailed pre- liminary engineering study of this phase of your water system should include surveys to obtain topography, investigation of soil conditions which affect construction, con- sideration of the existing and projected water demands, preparation of the overall de- sign including sizing of the various units , and preliminary plans to illustrate the nature of the improvements . Construction cost estimates and a financial plan, including an evaluation of the rate structure, would be prepared The engineering report could be expanded.so that it would meet the requirements for an areawide water plan, as set forth by the U.S. Department of Housing and Urban Development, Circular MPD 6415 .2A. The requirements for an areawide plan do not require the detailed analysis as described for the above study, but do require that the entire system, including distribution, be evaluated. The areawide water plan would be related to the comprehensive planning for the area. The need for public water facilities for the entire jurisdictional area of the Planning Board would be evaluated. An areawide plan would also include an updating of your capital improvement program as related to the need for water improvements. A third alternative would be to expand the evaluation of the transmission and dis- tribution system to include a Hardy Cross computer analysis . Such an analysis would provide the residual pressures at junction points throughout the system under varying combinations of domestic demand and fire flow requirements . The computer output would also provide the amount and direction of flow in each feeder main. The engineering fee for the detailed preliminary study of supply, storage , treatment, and transmission would be Nine Thousand Dollars ($9 ,000. 00) . To expand the report to provide an areawide plan would increase the engineering fee by Three Thousand Dollars ($3 ,000. 00) , and to expand the study to include a Hardy Cross computer analysis would cost an additional Three Thousand Dollars ($3 ,000. 00) .
