BOX 640 BOZEMAN MT 59715 CERTIFIED MAIL NOTICE OF VIOLATION: Requirements for Filtration and Compliance with the Surface Water Treatment Rule as Defined in ARM 16.20.208 Section 16.20.208 of the Administrative Rules of Montana (effective August 16, 1991) requires each public water supply system with a surface water source or a groundwater source under the direct influence of surface water to provide treatment by June 29, 1993 which meets the treatment technique requirements of this rule. The Department determined the City of Bozeman, Lyman Creek must install filtration to meet the requirements of ARM 16.20.208 and notices of this regulatory requirement were mailed to the City of Bozeman in December of 1991 and December of 1992. Our records indicate the City of Bozeman, Lyman Creek is in violation of ARM 16.20.208 because treatment of the surface water supply does not meet the requirements of the Surface Water Treatment Rule. Public notification of violations is required by ARM 16.20.229 and proof of notification is required to be provided to the Department by ARM 16.20.212(12) . Notice has not been received by the Department. Public notification of the violation of ARM 16.20.208 must be provided to users as outlined in ARM 16.20.229 and proof of notification must be mailed to the Department as required by 16.20.212(12) by no later than August 20, 1993. A compliance schedule for providing filtration of the City of Bozeman, Lyman Creek has been received by the Department for review. The Department may contact the representative for the City of Bozeman for additional information regarding the compliance schedule before approval is granted.
