In order to increase the supply of housing and specifically affordable housing in Bozeman here are suggested changes to the
UDC relative to Accessory Dwelling Units:
1. Permit ADUs by right in all Residential Zoning Districts
2. Remove maximum 2 person occupancy—BMC 38.360.040
3. Remove 600 square foot size limitation—BMC 38.360.040
4. Remove 1000 square foot lot size increase required for an ADU-BMC 38.320.030.A
5. Remove FAR restrictions for ADUs
6. Remove height and setback limitations found in BMC 38.360.030.G
7. Remove one bedroom restriction—BMC 38.360.040
8. Remove restriction stating no deviations for establishment of an ADU
9. Remove minimum lot width restrictions for ADUs—BMC 38.320.030.E
10. Remove ADU Parking restrictions—BMC 38.360.040
11. Remove restriction that ground level ADUs must have alley access—BMC 38.360.040
12.Allow one internal and one external ADU per lot
13.Allow deviations for ADUs—BMC 38.360.040
14. Insert California Code:
a.'An accessory dwelling unit that conforms to this subdivision shall be deemed to be an accessory use or an accessory
building and shall not be considered to exceed the allowable density for the lot upon which it is located,and shall be
deemed to be a residential use that is consistent with the existing general plan and zoning designations for the lot.The
accessory dwelling unit shall not be considered in the application of any local ordinance, policy,or program to limit
residential growth."
b. "...shall not impose parking standards for an accessory dwelling unit in any of the following instances:
i.The accessory dwelling unit is located within one-half mile of public transit.
ii.The accessory dwelling unit is located within an architecturally and historically significant historic district.
iii.The accessory dwelling unit is part of the existing primary residence or an existing accessory structure.
iv.When on-street parking permits are required but not offered to the occupant of the accessory dwelling unit.
v.When there is a car share vehicle located within one block of the accessory dwelling unit.
