COMMISSION RESOLUTION NO. 3313 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, PROVIDING AUTHORIZATION TO THE BOZEMAN CITY COMMISSION TO lEVY UP TO ONE Mill ANNUAllY ABOVE THE Mill lEVY CALCULATION ESTABLISHED BY SUBSECTION (1) OF SECTION 1 OF SENATE Bill 184, 56TH MONTANA lEGISLATURE, TO FUND SPECIAL TRANSPORTATION SERVICES FOR SENIOR CITIZENS AND PERSONS WITH DISABILITIES. WHEREAS, Section 7-14-111(1), Montana Code Annotated, provides that a municipality may, in addition to all other property tax levies authorized by law, levy up to one mill of property taxes to fund special transportation services for senior citizens and persons with disabilities; and WHEREAS, Subsection (2) of Section 1 of Senate Bill 184, 56th Montana Legislature, authorizes additional levies above the limit calculated under Subsection (1) that are approved by the voters; and WHEREAS, the City Commission desires to present to the electors a proposal to authorize the City of Bozeman to levy up to one mill annually to fund special transportation services for senior citizens and persons with disabilities. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana: Section 1 That the ballot question to authorize the Bozeman City Commission to levy up to one mill annually above the mill levy calculation established by Subsection (1) of Section 1 of Senate Bill 184, 56th Montana Legislature, to fund special transportation services for senior citizens and persons with disabilities shall be submitted to the registered electors of the City of Bozeman at the municipal general election to be held on Tuesday, November 2, 1999, and the wording of the ballot measure shall be substantially as follows: That the City Commission of the City of Bozeman, Montana, be authorized to levy up to one mill annually above the mill levy calculation established by Subsection (1) of Section 1 of Senate Bill 184, 56th Montana Legislature, to fund special transportation services for senior citizens and persons with disabilities. o FOR Authorizing the City Commission of the City of Bozeman to levy annually up to one mill of property taxes above the mill levy calculation established by Subsection (1) of Section 1 of Senate Bill 184, 56th Montana Legislature, to fund special transportation services for senior citizens and persons with disabilities. .. ...- .---.. ........-.....- -.---.. o AGAINST Authorizing the City Commission of the City of Bozeman to levy annually up to one mill of property taxes above the mill levy calculation established by Subsection (1) of Section 1 of Senate Bill 184, 56th Montana Legislature, to fund special transportation services for senior citizens and persons with disabilities. Section 2 That, upon a favorable vote of the public, the mill levy may be set and levied by the City Commission annually, with those property tax revenues being used for the single purpose of contributing toward special transportation services for senior citizens and persons with disabilities.
