HomeMy WebLinkAboutResolution 3762 Plan 2020 Growth Policy Amendment, land use designation changes, Cattail Creek Subdivision COMMISSION RESOLUTION NO. 3762 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING THE GROWTH POLICY LAND USE DESIGNATIONS, AS SHOWN ON THE FUTURE LAND USE MAP IN THE BOZEMAN 2020 COMMUNITY PLAN, FROM "BUSINESS PARK" TO "RESIDENTIAL" ON 22.57 ACRES, FROM "BUSINESS PARK" TO "NEIGHBORHOOD COMMERCIAL" ON 5.97 ACRES, AND FROM "INDUSTRIAL" TO "NEIGHBORHOOD COMMERCIAL" ON 7.78 ACRES, L YINGALONG NORTH 27TH AVENUE WITHIN CATTAIL CREEK SUBDIVISION. WHEREAS, the proposed growth policy amendment to amend the growth policy land use designations, as shown on the Future Land Use Map in the Bozeman 2020 Community Plan, from "Business Park" to "Residential" on 22.57 acres, from "Business Park" to "Neighborhood Commercial" on 5.97 acres, and from "Industrial" to "Neighborhood Commercial" on 7.78 acres has been properly submitted, reviewed and advertised; and WHEREAS, the Bozeman Planning Board held a public hearing on May 18, 2004, to receive and review all written and oral testimony on the request for a growth policy amendment; and WHEREAS, the Bozeman Planning Board voted 5-2 to recommend to the Bozeman City Commission that the growth policy amendment be approved as proposed; and WHEREAS, after proper notice, the City Commission held its public hearing on June 7,2004, to receive and review all written and oral testimony on the request for a growth policy amendment; and WHEREAS, the City Commission has reviewed and considered the four growth policy amendment criteria established in Section 2.4.1 of the Bozeman 2020 Community Plan, and found that the proposed growth policy amendment would be in compliance with the four criteria; and WHEREAS, at its public hearing held on June 7, 2004, the City Commission found that the proposed growth policy amendment would be in compliance with Bozeman's adopted growth policy and would be in the public interest. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana: Section 1 That the growth policy land use designation of the following-described properties is hereby designated as Residential: Com menci ng at the north quarter corner of said Section 35; thence South 89045' 15" West, along the north line of said Tract 1, a distance of 432.52 feet to the Point of Beginning; thence South 00013'52" West, a distance of 830.34 feet to a point to be hereinafter referred to as Point A; thence South 89044'23" West, along the north line of the plat of Cattail Creek Subdivision, Phase 1, a distance of 797.59 feet; thence North 00013'52" East, a distance of 830.54 feet to a point on the north line of said Tract 1; thence North 89045'15" East, along said north line, a distance of 797.59 feet to the Point of Beginning. Said parcels containing 15.20 acres more or less. Beginning at the point hereinbefore referred to as Point B; thence North 89046'08" West, along the north line of Lot 3 of Block 7 and the easterly extension of said line, a distance of 332.50 feet; the following four (4) courses being along the centerline of North 27th Avenue: thence South 00013'52" West, a distance of 288.91 feet to the point of curvature of a curve to the left, having: a radius of 300.00 feet, a central angle of 41 017'35", a chord bearing of South 20024'56" East, and a chord length of 211.56 feet; thence along the arc of said curve, an arc length of 216.21 feet to the end of said curve; thence South 41003'43" East, a distance of 470.98 feet to the point of curvature of a curve to the right, having: a radius of 300.00 feet, a central angle of 16034'07", a chord bearing of South 32046'40" East, and a chord length of 86.75 feet to the end of said curve and a point on the east line of the plat of Cattail Creek Subdivision, Phase 1. Thence on a non-tangent course South 00013'52" West, along the east line of said plat, a distance of 126.05 feet to the southeast corner of said plat and the center of said Section 35; thence South 89041'58" West, along the south line of said plat, a distance of 239.20 feet; thence North 00018'02" West, a distance of 30.00 feet; thence North 34001 '59" West, along the southwesterly line of Lot 1 of Block 5, a distance of 279.88 feet; thence North 73019'32" West, a distance of 85.32 feet; thence North 30022'19" West, along the southwesterly line of Lots 2 and 3 of Block 8, a distance of 504.52 feet; thence North 24001'38" West, a distance of 71.25 feet; thence North 00013'52" East, along the west line of Lot 3 of Block 7, a distance of 256.85 feet to the Point of Beginning. Section 2 That the growth policy land use designation of the following-described property is hereby designated as Neighborhood Commercial: Beginning at the point hereinbefore referred to as Point A; thence South 00013'52" West, along the centerline of North 27th Avenue, a distance of 782.93 feet; thence North 89046'08" West, along the south line of Lot 2 of Block 7, a distance of 332.50 feet to a point to be hereinafter referred to as Point B; thence North 00013'52" East, along the west line of Lots 1 & 2 of Block 7, and Lot 2 of Block 2, a distance of 780.08 feet to a point on the north line of Cattail Creek Subdivision, Phase 1; thence North 89044'23" East, along said north line, a distance of 332.51 feet to the Point of Beginning. Said parcel containing 5.97 acres more or less. Commencing at the north quarter corner of said Section 35; thence South 00013'52" West, a distance of 830.23 feet to the northeast corner of the plat of Cattail Creek Subdivision, Phase 1, and the Point of Beginning; thence South 00013'52" West, along the east line of said plat, a distance of 785.10 feet; thence North 89046'08" West, along the south line of Lot 2 of Block 4 and said line's westerly extensionh a distance of 432.50 feet; thence North 00013'52" East, along the centerline of North 271 Avenue, a distance of 781.39 feet to a point on the north line of said plat; thence North 89044'23" East, along said north line, a distance of 432.52 feet to the Point of Beginning.
