UJ ~ MONTANA. PROVIDING FOR THE ANNEXATION OF A CERTAIN TRACT OF M ; LAND. HEREINAFTER DESCRIBED. TO THE CORPORATE LIMITS OF THE CITY UJ:: OF BOZEMAN AND THE EXTENSION OF THE BOUNDARIES OF THE CITY OF ,.... 0 g BOZEMAN SO AS TO INCLUDE SAID TRACT. CO-~ --CO> '11""1-- m- N-IO tL IS WHEREAS, the City of Bozeman received a petition for annexation from Stiff Cheese LLC, sole ___or;! ~: owner of the lot, requesting the City Commission to extend the boundaries of the City of Bozeman so as - =:; to include Lot 1A1, Block 4, Walker Property Subdivision PUD, located in the County of Gallatin, State --- - 0 of Montana; and -en E WHEREAS. an annexation staff report was prepared in accordance with the Commission's _I- _ ~ goals and policies for annexation and was presented to the Commission at its regular meeting held on _0 =:;!; July 26, 2004; and _ ~ WHEREAS. the City did not receive any written protest from the real property owners of the -- _ 'f area to be annexed; and -- _0 _ ~ WHEREAS. on July 26. 2004, the Commission authorized and directed staff to process a "Part -> ! 46 Annexation" and prepare the necessary documents to proceed with the annexation of this lot in i accordance with their decision regarding the provision of services to said tract; and WHEREAS. the provision of available services. including, but not limited to, rights-of-way, easements, water rights or cash in lieu, waivers of protest against creation of SID's and water and sewer hookup fees. to said lots is the subject of a written agreement between the City of Bozeman and Stiff Cheese. LLC, record owner of the lot; and WHEREAS. said lot is the subject of a plat, filed in the office of the Gallatin County Clerk and Recorder's Office; and WHEREAS. the Bozeman City Commission hereby finds that the annexation of this lot is in the best interests of the City of Bozeman and the inhabitants thereof and of the inhabitants of the tract. NOW. THEREFORE. BE IT RESOLVED by the City Commission of the City of Bozeman. Montana: Section 1 That it is hereby declared that, pursuant to Title 7. Chapter 2, Part 46, MCA, the following- described property be annexed to the City of Bozeman and that the boundaries of said City shall be modified so as to embrace and include such 0.937 acres of land, to wit, and as further described on Exhibit A, attached hereto: Lot 1 A 1, Block 4. Amended Plat of Lots 1 A, 2, 3, and 4A. Block 4, Walker Property Subdivision PUD, located in the southeast quarter of Section 26, Township 1 South, Range 5 East, MPM, Gallatin County, Montana. as filed with the Gallatin County Clerk and Recorder. ~ ,- Section 2 The effective date of this annexation is March 25, 2005. Section 3 The annexation of the above-described tract is subject to the terms of the Agreement dated March 7,2005, by and between the City of Bozeman and Stiff Cheese, LLC.
