So we are a little away from getting the site plan approval, but when it is time to either use the water
credit or Cash in lieu, I will do that when it is required as we have talked before. I might be selling the
project to others and that will made the call for me.

Ryan - With written concurrence from Kevin, required CILWR will debit from the
available credits. Please work with Griffin to determine the quantity of credits
required for the development.

Hello Brian,
We are preparing a Site Plan resubmittal for the Fallon Condos project (COB #
21175) within Norton Ranch Subdivision Phase 4 (civil cover sheet attached for
reference). The Site Plan requirements outline that we need to confirm the
CILWR or WR donation calculations with you.
The Fallon Condos site plan includes 18 buildings totaling 22 units.
You has previously indicated that four (2) multi-family water rights credits
(WRCs) were dedicated to the property during the platting of Phase 4 (one per
lot). Given the proposed 22 units, an additional 20 WRCs are required. You had
also indicated that the owner, Kevin Spencer (copied here), maintains greater
than 60 acre-feet worth of WRCs.
Based to the City’s acre-feet to water credit conversion for multi-family use, one
(1) WRC = 0.124 acre-feet. Therefore, the additional 20 WRCs result in 2.48
acre-feet. The owner, Kevin Spencer (copied here), would like to dedicate this
4.48 acre-feet from his WRC balance to this project. Therefore, no additional
CIL payments are required.
Kevin – Can you please confirm that this is you intent?
