Project Details
The zoning is M-1 and the use will be Manufacturing, Moderate. The facility will include a retail area
showcasing the company’s custom machined metal products, administrative offices, a machine shop, a
large crane for loading and unloading materials, and 5 loading bays. The building will have varying
heights with a maximum building height of 24’ with a butterfly roof sloping at 1:12. Parapeted portions
of the building will have a maximum height of 22’. The maximum building size will be 24,246 sq. ft. The
building will be a pre-manufactured metal building utilizing clear span steel framing with pre-
manufactured insulated panels designed and manufactured by STAR Building Systems. The type of
building will be clear span steel frame built on a slab. The building and site will be built to zoning codes
and provide the required off street parking and improvements. The drive access will utilize the platted
shared access easement bordering Lot 10. Landscaping will be designed to meet City of Bozeman
requirements, and garbage enclosure shall be designed to blend in with the building character. Per civil
recommendations, the proposed onsite drainage will utilize an underground retention system.
The timeframe for the project is planned to begin construction spring 2021.

Section 2 – RECOMMENDED CONDITIONS OF APPROVAL
Please note that these conditions are in addition to any required code provisions identified in this report.
These conditions are specific to the development.
1. The applicant is advised that unmet code provisions, or code provisions that are not specifically
listed as conditions of approval, does not, in any way, create a waiver or other relaxation of the
lawful requirements of the Bozeman Municipal Code or state law.

Section 3 – REQUIRED CODE CORRECTIONS All citations are to the Bozeman Municipal Code (BMC).

1. Sec. 38.530.070. - Blank wall treatments.
a. The section of façade that has a rectangle on it appears to be a blank wall.

c. Please clarify if the proposed screening, Skyracer Moorgrass will cover 60% of the blank
wall shown on the left below within 3 years.
RESPONSE: the fascade is setback from the public view / right of way, and will be covered
by 60% with Skyracer Moon grass.
2. Sec. 38.520.040. - Non-motorized circulation and design.
a. Please provide crosswalks between all on-site paved areas accessible to vehicles.
Crosswalks must contain contrasting materials such as concrete and/or patterns such as
stamped asphalt. Paint is not an acceptable material for crosswalks.
See revised C2.0.
b. Please provide dimensions of all sections of pathways to ensure they meet the minimum
width of 5’.

ENGINEERING COMMENTS:
Stormwater
1. BMC 40.04.700 – Drainage cannot be directed onto adjacent properties in a manner or volume
which differs from historic patterns. The applicant must submit a grading plan showing slopes
directing runoff onto the property for detention and treatment.

a. The contours shown on Sheet C4.0 show runoff from the landscaped areas on the
perimeter of the site will flow to the adjacent properties.
See revised sheet C4.0. We are now calling for 1’ deep by 1’ wide trench drains off the
back of sidewalks on the north side of the building. These trench drains are sized to
handle the runoff from said sidewalk. The other area is now called out as drainage
area 6 in the updated stormwater design report. This lot is currently an open field and
is being changed to a landscaped area which have the same C coefficient for
calculating runoff. Also the site historically drains to the north and remains draining to
the north after construction so the historical drainage patterns are maintained.
2. Stormwater Design Report
a. The applicant must provide the calculations for the storage provided by the stormtech
systems.
The updated stormwater report.
b. A portion of the volume used in the drywell storage volume calculations is below the
high groundwater level. The applicant must provide the required storage above the high
groundwater level.
This has been rectified by increasing the radius of gravel surrounding the drywell and
only counting a small 0.05’ portion of rock under the well as retention volume. The
detail calls for a minimum of 6” of gravel however, the calculation only accounts for
said 0.05’ which is above approximate high groundwater.
c. The storage volume for the drywell utilized porosity instead of void ratio in the
calculations. This has resulted in calculated storage volumes higher than the storage
volume available.
This term been changed to “stone porosity of 40%”. The term “void ratio” has been
removed.
Water Rights
1. BMC 38.410.130 (A) (1) Water rights - The applicant must contact Griffin Nielsen with the City
Engineering Department to obtain a determination of cash-in-lieu of water rights (CILWR).
CILWR must be paid prior to site plan approval.
a. The correspondence referenced in the application narrative was not provided.
RESPONSE: Request has been made awaiting response from City Engineering
Department.
Wastewater
1. The applicant is advised that the Nelson Meadows development will be serviced by a future lift
station (Davis Lane Sanitary Sewer Lift Station). Currently, the lift station is under contract for
construction with an anticipated completion date mid-2021. In addition to the lift station, there
is currently no sanitary sewer connection from the Nelson Development to the City’s
wastewater collection system. Based on these existing circumstances, a “No Build Restriction”
on all lots has been filed. The “No Build Restriction” will remain in place until the Davis Lift
station as well as the Nelson Meadows connection is operational and accepted by the City.
RESPONSE: Understood
2. BMC 38.410.070 (A) (1) Municipal water, sanitary sewer and storm sewer systems - The
applicant must provide additional supporting information for the average daily demand and
maximum daily demand assumptions.

3. DSSP V.D.5.c - The proposed sewer service is too close to the building. Per the City of Bozeman’s
Design Standards and Specifications Policy (DSSP), the services must be 10 feet from trees and
structures. The applicant must attempt to meet this requirement as best as possible.
See updated sheet C2.0. The sewer service has been moved.
Water
1. DSSP V.D.1- Ten feet of separation must be maintained between water services and any gas
lines, power lines, communication lines, utility poles or other above-grade utility structures and
street lights.
a. Proposed site lighting and the gas and underground electric lines are less than ten feet
from the domestic water and fire services.
A fire service is no longer proposed. Also, the water riser room has been moved and
this is no longer an issue. See updated Sheet C3.0.
Conditions of Approval
1. City of Bozeman Resolution 5076, Policy 1 - The applicant must provide and file with the County
Clerk and Recorder's office executed Waivers of Right to Protest Creation of Special
Improvement Districts (SID’s) on City standard form for the following:
a. Street improvements to Prince Lane between Nelson Road and Frontage Road including
lighting, signalization, paving, curb/gutter, sidewalk, and storm drainage.
b. Street improvements to Nelson Road between Frontage Road and Prince Lane including
lighting, signalization, paving, curb/gutter, sidewalk, and storm drainage.
c. Street improvements to Frontage Road between Nelson Road and East Valley Center
Spur/Prince Lane including lighting, signalization, paving, curb/gutter, sidewalk, and
storm drainage.
d. Intersection improvements at Prince Lane and Nelson Road including lighting,
signalization/channelization, paving, curb/gutter, sidewalk, and storm drainage.
e. Intersection improvements at Prince Lane and Royal Wolf Way including lighting,
signalization/channelization, paving, curb/gutter, sidewalk, and storm drainage.
f. Intersection improvements at Prince Lane and Frontage Road Avenue including lighting,
signalization/channelization, paving, curb/gutter, sidewalk, and storm drainage.
g. Intersection improvements to Nelson Road and Frontage Road including lighting,
signalization/channelization, paving, curb/gutter, sidewalk, and storm drainage.
h. Intersection improvements to East Valley Center Spur and Frontage Road including
lighting, signalization/channelization, paving, curb/gutter, sidewalk, and storm drainage.
The document filed must specify that in the event an SID is not utilized for the completion of
these improvements, the developer agrees to participate in an alternate financing method for
the completion of the improvements on a fair share, proportionate basis as determined by
square footage of property, taxable valuation of the property, traffic contribution from the
development, or a combination thereof. The applicant must provide a copy of the filed SID
waiver prior to site plan approval.
A draft SID waiver is included with this resubmittal for review. If acceptable, it will be
executed and filed before site plan approval.
ENGINEERING ADVISORY COMMENTS:

1. The Engineering Division has some concerns with the maintainability of the pipes exiting the
inlets. The applicant should consider how they will maintain these pipes.
The pipe entering the drywell has been upsized to 12” for ease of maintenance.
2. The Engineering Division recommends upsizing the inlet pipe to the Stormtech isolator row for
ease of maintenance.
The 12” pipe entering the Stormtech system cannot be upsized. 12” is the largest pipe that can
connect to this SC-310 System.
3. DSSP Fire Service Line Standard - The applicant must prepare plans and specifications for any fire
service line in accordance with the City’s Fire Service Line Policy. The plans must be prepared by
a Professional Engineer and be provided to and approved by the City Engineer prior to initiation
of construction of the fire service or fire protection system. The applicant must also provide
Professional Engineering services for construction inspection, post-construction certification and
preparation of mylar record drawings. Fire service plans, and domestic services 4” or larger, must
be a standalone submittal, separate from the site plan submittal. City of Bozeman applications for
service must be completed by the applicant.
No fire line is proposed.

1. Verify that the spray booth, powder coating, and sand blaster equipment is listed and all Electrical
and Mechanical required are provided per the Building codes and the manufactures
requirements.
RESPONSE: Equipment shall be listed in the final construction drawings for building permit
2. Need to provide the quantities of hazardous gas or materials. As well the storage location. If these
hazardous gas exceed the limits allowed could require a H occupancy with in their design.
RESPONSE: No hazardous gas or materials are stored or used on site.
3. List of hazardous materials is required at time of submittal.

submitted for building permit.

1. Has an application to Northwestern Energy (NWE) been submitted?
YES
2. If not please submit an application online to have the NWE project engineer work with the
applicant. Go to www.northwesternenergy.com/construction to apply online Montana
Construction Application, and access Montana New Service Guide to provide information on
electric and gas service requirements.
3. According to NWE utility maps there is an existing electric junction can installed at the
southeast corner of Lot 9. This same location is where the applicant is showing an entry off
Nelson Road. This electric junction can will need to be relocated if it is in the same location
as the entry.
Based on conversation with Nick Haag, the junction can is actually located on the adjacent
lot to the south and not the subject property.

4. With the proposed location of the electric meter either primary will need to be extended to
a point where a transformer will need to be installed or if it is possible a junction can or
transformer will need to be cut into the existing primary. One of these options or one that is
not described here will need to be determined by the NWE project engineer.
This is understood. It would be preferred to cut in to the existing primary at the
transformer location shown to avoid additional trenching along the Nelson Road utility
easement.
5. Meters in General. NorthWestern Energy reserves the right to specify the location of NWE
meters. All meters are to be located outdoors on the corner of the building closest to the
transformer serving your property. On new construction, electric meter locations must be
within 10 feet of the gas meter if NorthWestern Energy will be providing both electric and
gas service. Meter locations will need to be approved by NWE. NWE policy is to maintain a
minimum 30-inches wide by 3-feet clear zone between the front of the meter and landscape
screening or wall screening for self-contained meter bases and 48-inches for installations
requiring cabinets. Location of the meter(s) shall allow easy access to the meters for
operation and maintenance.

The Water Conservation Division appreciates the use of drought tolerant plant species and specification
of best practice irrigation installation methods. The following recommendations to the Midwest Welding
and Machine project plan are provided to maximize landscape health and resiliency while minimizing
outdoor water consumption.
1. Indicate the total landscaped area (ft2) of tree, shrub, and perennials beds on sheet L600.
RESPONSE: See sheet L600 for this table
2. On sheet L600, please clearly specify whether irrigation will be connected to City water
connection.
RESPONSE: See note on sheet L600
3. On sheet L600, specify the installation of water efficient sprinkler nozzles (multi-spray, multi-
trajectory nozzles or ‘rotary nozzles’) within turf grass lawn areas.
RESPONSE: See irrigation notes and water usage table for clarification
4. On sheet L001, a symbol within the legend does not clearly indicate the type of landscaping
that is associated with the pattern (see screen shot of pattern below). Please indicate what
type of vegetation/landscaping is to be installed in these areas.
The description of this symbol is 1-1/2” all rounds which is a landscape rock. The description in the
third column was an error and has been corrected to say landscape rock.

2. Please verify fire apparatus turning radii for west end parking area.

3. If turning radii cannot be met, provide 2nd compliant access or re-design site plan as needed.
The turning radius is met. There is no need for an additional exit.
