RE: Deviation Request to BMC 38.400.010.A.2 Westland Lofts Mixed Use MASP/CUP
AND Site Plan (COB 918-557, 18-558);
Dear Griffin,
This letter is to provide a deviation request to the drive access standards listed in the Bozeman
Unified Development Code for the project referenced above.
The centerline of the northern drive access off of Gallatin Green Boulevard to the proposed
development is offset from the centerline of Kimberwicke Street by approximately 10 feet.Section
38.400.010.A.2 BMC states that; "The developer must arrange the streets and alleys to provide for
the continuation of streets and alleys between adjacent developed properties when such
continuation is necessary for the convenient movement of traffic,effective provision of emergency
services and efficient provision of utilities." As platted, the northern property boundary of the
proposed development does not align with the intersection of Kimberwicke Street and Gallatin
Green Boulevard;therefore, aligning this access exactly to Kimberwicke is not possible. The two
drive accesses on the site were separated as far as possible to provide two means of ingress/egress
to the property while still maintaining applicable separation requirements. All other drive access
requirements outlined in section 38.400.090.C.3.b BMC are satisfied with the proposed layout.
Traffic from Kimberwicke is stopped at this intersection so drivers will be able to see traffic
entering and leaving from this site access. Furthermore, the development will only generate 19
AM peak hour trips and 21 PM peak hour trips. The proposed access will function properly given
the relatively low trip rates that are produced from the development.
