DRAINAGE EASEMENT
Gallatin Mall Group, LLC, a Montana Limited Liability Company, of 2280 Grant Road, Suite A,
Billings, MT 59102-6696, the GRANTOR, in consideration of One Dollar ($1.00) and other
good and valuable consideration, receipt of which is hereby acknowledged, grants to the City of
Bozeman, a municipal corporation of the State of Montana, with offices at 121 North Rouse
Avenue, Bozeman Montana 59715, GRANTEE, its successors and assigns, an easement for
public drainage purposes, in, through and across the following described real property situated in
Gallatin County, Montana:
Tract 1 of Certificate of Survey No. 467A, City of Bozeman, according to the plat
thereof, on file and of record in the office of the Clerk and Recorder, Gallatin County,
Montana and located in the SW 1/4 of Section 11, T. 2 S., R. 5 E. of P.M.M..
The easement is more particularly shown and dimensioned on th 'attached-Ex Ybit , which b

this reference is made a part of this document.
The purpose of the easement is for the operation, maintenance, repair, and replacement of an
existing underground stormwater pipeline and the re-alignment of a portion of the same. If the
use of this underground stormwater pipeline is ever discontinued, the easement will
automatically terminate.
The GRANTOR warrants that it is lawfully seized and possessed of the real property described
above, that it has lawful right to convey the property, or any part of it, and that it will forever
defend the title of the property against the claims of all persons. The GRANTOR further agrees
that the GRANTEE may peaceably hold and enjoy the rights and privileges herein granted
without any interruption by the GRANTOR.
The terms, covenants and provisions of the easement and agreement shall extend to and be
binding upon the heirs, executors, administrators, personal representatives, successors and
assigns of the parties hereto.
