Project Type & Use Scope
• The property is located between two arterial roads (Davis Lane and E Valley Center Road) and a
local road (Westlake Rd), and is fronted by the Interstate 90. The property is adjacent to the
Billings Clinic multi-story building under construction. The current growth policy has the parcel
listed as Residential Mixed Use and are proposing R-5 zoning. The community needs residential
currently and this annexation intends to provide high density residential with mixed uses that
are permitted within the zoning designation.
ZMA Questions:
a. Is the new zoning designed in accordance with the growth policy? How? Yes. The Future Land
Use Map has the parcel outlined as Residential Mixed used which correlates w/ Zoning types =
R-3, R-4, R-5, R-O, REMU, B-1, PLI.
b. Will the new zoning secure safety from fire and other dangers? How? The parcel will maintain
safety from fire and other dangers. It is currently vacant agricultural land and is surrounded
by public rights-of-way on all sides. The new zoning will follow all regulated requirements to
ensure the parcel maintains safety from fire and other dangers.
c. Will the new zoning promote public health, safety and welfare? How? Yes. The purpose of the
zoning regulations is to promote the public health, safety and general welfare by: preventing
the creation of private or public nuisances caused by noncompliance with the standards and
procedures. The development will be complying with all zoning standards. The agricultural
parcel there will not be any noncompliance with the standards.

d. Will the new zoning facilitate the adequate provisions of transportation, water, sewage,
schools, parks and other public requirements? How? The surrounding infrastructure
and utilities will be improved, expanded, extended, and upgraded with the
development of the parcel. Surrounding roads and failing intersections will be
improved and built to city standards. Water will be extended along the length of the
property. Sewer is able to gravity feed into the newly constructed sewer service.
Parkland or cash-in-lieu for improvements to neighboring parks will be provided for
residential development.
e. Will the new zoning provide reasonable provision of adequate light and air? How? Yes. The
purpose of the zoning standards is ensuring light and air is provided in new development. The
development will be following all zoning standards to safeguard all adjacent landowners to
appropriate light and air.
f. Will the new zoning have an effect on motorize and non-motorized transportation systems?
How? Yes. The adjacent right of ways will be upgraded to city standards and intersections
improved making both vehicular and non-motorized transportation safer around the site. The
zoning standards will also require safe and adequate internal site transportation as well.
g. Does the new zoning promote compatible urban growth? How? Yes. The zoning designation
requested, R-5, is a compatible zoning with what the Future Land Use map defines the
property, Residential Mixed Use.
h. Does the new zoning promote the character of the district? How? Yes. The zoning will be
responsible for defining the character of the district. The Future Land Use map indicates the
parcel is to be primarily residential use with commercial as a potential auxiliary use. R-5
zoning will provide this type of development. In addition, surrounding development will also
influence the character of the district. Billings Clinic is leading the way for the quality and
character of the district and this property being adjacent will be following their lead.
i. Does the new zoning address the affected area’s peculiar suitability for particular uses? How?
Yes. The parcel is adjacent to Regional Commercial Services Land Use and the new zoning is
an appropriate neighboring use helping to promote mixed use development within the
district.
j. Was the new zoning adopted with a view of conserving the values of buildings? How? N/A.
There are no existing buildings on the site.
k. Does the new zoning encourage the most appropriate use of land throughout the
jurisdictional area? The new zoning will create the highest and best use of the property. The
property has great vehicular access and adjacent development will create a synergy that will
make the parcel well balanced in the mixed-use district. R-5 zoning is the most appropriate
use of the land for the jurisdictional area.
