Over the years, the developer, has through a Planned Unit Development process, (PUD) submitted a number of different designs and through much deliberation and vetting by the appropriate officials the project has been given the necessary approvals to proceed ahead. City engineers, the Fire Marshall, Wetland scientists, Corp of Engineers personnel and City Floodplain Manager have all visited the site and gave advice and guidance to the developer. This advice and guidance was incorporated into the final development plans. In the past couple of years the applicant has removed approximately 3 tons (21 cubic yard dumpster) of discarded debris from homeless camps on the the property. Recently a new homeless camp has been created on the property. In review of comments submitted thus far, very few folks know the history of this parcel of land. For many years the property belong to the St Paul/Pacific Railroad Company. They operated a spur line on the property, evidenced by the rail road bed on the property. The properties southern boundary is adjacent to an industrial park, the east property boundary abuts to a dense townhome development, and the north and west property boundaries lie adjacent to heavily used public trails. . The neighboring Townhome development to the east of the subject site was approved years ago landlocking the applicants property. The approval of the Townhome development to east of the applicants property has caused all of the access problems. Four relaxations are related to this problem. State law specifically prohibits one landowner from land locking another land owners access to their property. This is an infill project and should be approved by the City Commission.
