It is our interpretation of Section 3 of Resolution 4784 that this property has the following favorable circumstances for acceptance of Cash-in-Lieu: - The travel distance from the nearest point of the development to the nearest point of two or more existing neighborhood, community, or regional parks is within 0.25 miles of the development site or a single neighborhood, community, or regional park is within 300 feet of the development site. We are also providing direct pedestrian connections to nearby open spaces across Sherwood Way to the south of the property which is less than 300 feet from the development site. Additionally, open/park spaces within a ¼ mile radius include a picnic shelter off Rosa & Annie Street, the Laurel Parkway playground and the open space trail system along Baxter Creek. The soccer complex is also within a ½ mile radius. - The proposed development is unable to meet the parking development standards, e.g. frontage or accessibility. The property does not have much usable street frontage areas for the park to be accessible to the public, except where the retention facility is located. - The acceptance of cash-in-lieu enables accomplishment of other City priorities such as infill, enhancement of existing parks to better serve the dedicating development and other users. The cash-in-lieu can be used to help the City and GVLT with the Westside Paths and Trails Project. The funds can help establish the Oak Street Shared Use Path as well as trail improvements or gaps in the trail network that still need to be installed.
