The specific portion of the departure is regarding the residential requirement for ground level outdoor spaces to be enclosed by a fence and /or hedge at least 32” in height. It is our opinion that we are successfully meeting the intent of the requirement with an 18” high split face CMU block barrier. Attached are photos of the 18” high barrier design that clearly defines the private and public space. Please let me know if you have any concerns or questions regarding our Departure request.
