The original application and aquatic resources summary was sent to your office in September 2020. Two issues regarding jurisdictional status have arisen since the aquatic resources summary was completed. The first issue concerns wetland-3. A USACE Project Manager (Jade) visited the project site in 2019 to make a determination on jurisdictional status of wetland-3. I do not believe we received official correspondence regarding the wetland-3 JD determination. However, you and I recently discussed this wetland’s location within the East Gallatin floodplain and that it is likely jurisdictional because of its landscape position. The enclosed 404 application assumes wetland-3 is jurisdictional. The remaining important issue concerns wetland-4-4a/NWW-1-1A. These connected features were created to convey stormwater and groundwater off adjacent streets and property. Because of USACE 2020 rule changes this feature may be nonjurisdictional. If this may be the case, I will immediately forward a JD determination request form. The enclosed 404 application assumes wetland-4/4a & NWW-1/1a are jurisdictional. Total proposed impacts are 0.090 acre, regardless of jurisdictional status. No mitigation should be required for impacts less than 0.1 acre.
