Box 1065 Shaliay VAno"allatln Co t1T MISC 33.00 Bozeman,MT 59771 ABANDONMENT OF EASEMENTS NORTH ROAD EASEMENT COMES NOW the City of Bozeman,411 East Main, Bozeman, MT 59715,a Municipal Corporation of the State of Montana hereinafter("GRANTOR")and does hereby release, reconvey and abandon the following described easements unto B& K Holdings, LLC("GRANTEE") as follows: WITNESSETH: WHEREAS, the Grantor is the legal record title holder of a Roadway and Street Easement on behalf of the general public situated across a portion of.- Lot 1 of Amended Plat of Block 2, Bridger Center Subdivision, located in the SE '/4 of Section _ 31,Township 1 South,Range 6 East,P.M.M.,City of Bozeman, Gallatin County Montana according to the official plat thereof on file and of record in the office of the County Clerk and Recorder, Gallatin County, Montana [Plat Ref H-37-E]. WHEREAS,a Roadway Easement was originally established across a portion of Block 2 of Bridger Center Subdivision and is recorded at Film 63, Page 758 at the Clerk and Recorder's Office of Gallatin County, Montana. WHEREAS, subsequently a Roadway and Street Easement for road use of the general public was conveyed for the same portion of Block 2 of Bridger Center and is recorded at Film 69,Page 2245 at the Clerk and Recorder's Office of Gallatin County, Montana. WHEREAS, that same Roadway and Street Easement for road use of the general public now encumbers Lot 1 of Amended Plat of Block 2, Bridger Center Subdivision [Plat Ref H-37-E]. WHEREAS the construction of the roads dedicated to the public in Bridger Center Subdivision have been completed without having to occupy said easement,the vacation of all of said easement will not adversely impact the Grantor's interests. WHEREFORE,the Grantor does hereby release,reconvey and abandon in favor of the Grantee those portions of the Roadway and Street Easement located on the above described real property as set forth in the "shaded area" of Exhibit A attached hereto together and incorporated by reference herein with any right, title, or interest that the Grantor may have in said Roadway and Street Easement described as follows: Abandon the Roadway and Street Easement to the City of Bozeman for road use of the general public as previously shown on Film 63,Page 758 and Film 69, Page 2245 at the Clerk and Recorder's Office of Gallatin County, Montana situated across a portion of Lot 1 of Amended Plat of Block 2,Bridger Center Subdivision, to the City of Bozeman in the SE '/4 of Section 31, Township 1 South, Range 6 East,P.M.M, City of Bozeman, Gallatin County, Montana (Plat Ref H-37-El.
