NOTICE IS HEREBY GIVEN that the City of Bozeman, Montana, is accepting sealed
bids for:
Rouse Avenue Lighting Between Main Street and Lamme Street
Separate sealed bids for construction of City of Bozeman Rouse Avenue Lighting
Between Main Street and Lamme Street will be received by the City Clerk at the office
of City Hall, 121 North Rouse Ave., P.O. Box 1230, Bozeman, Montana 59771-1230
until 2:00 p.m., local time, Thursday, July 1, 2021 and then publicly opened and read
aloud.
Please write the name of the project on the front of the sealed bid.

Bids must be received before 2 p.m. local time, Thursday, July 1, 2021. Original
copies must be submitted- no faxed or electronic bids will be accepted. Bids will be
opened and read following the close of bids.

The project work is generally described as follows:
New streetlight wiring and pole installation on both sides of Rouse Avenue from Main
Street to Lamme Street including: spot replacement of existing sidewalks, wire
installation into existing and new conduit, coordination for owner supplied pedestrian
lights, restoring boulevards to pre-existing conditions and all related work incidental to
construction.
The work will be completed within 45 calendar days following Notice to Proceed.
The Contract Documents may be electronically obtained at the office of TD&H
Engineering; 234 East Babcock, Suite 3, Bozeman, Montana 59715 or at the Downtown
Bozeman Partnership, 222 East Main Street #302, Bozeman, Montana 59715, 406-586-
4008, in accordance with the Instructions to Bidders.

Each bid or proposal must be accompanied by a Certified Check, Cashier’s Check, or
Bid Bond payable to the City of Bozeman, Montana, in an amount not less than ten
percent (10%) of the total amount of the bid. Successful BIDDERS, shall furnish an
approved Performance Bond and a Labor and Materials Payment Bond, each in the
amount of one hundred percent (100%) of the contract amount. Insurance as required
shall be provided by the successful BIDDER(s) and a certificate(s) of that insurance
shall be provided.
No bid may be withdrawn after the scheduled time for the public opening of bids, which
is at 2:00 p.m. local time, Thursday, July 1, 2021.
Non-Discrimination
CONTRACTOR and any of the CONTRACTOR’S subcontractors bidding or doing work
on this project will be required to be registered with the Montana Department of Labor
and Industry (DLI). Forms for registration are available from the DLI, PO Box 8011,
1805 Prospect, Helena, Montana 59604-8011. Information on registration can be
obtained by calling (406) 444-7734. CONTRACTOR is not required to have registered
with the DLI prior to bidding on this project, but must have registered prior to execution
of the Construction Agreement. All laborers and mechanics employed by
CONTRACTOR or subcontractors in performance of the construction work shall be paid
wages at rates as may be required by the laws of Gallatin County and the state of
Montana. Discrimination in the performance of any agreement awarded under this
project on the basis of race, color, religion, creed, sex, age, marital status, national
origin, or actual or perceived sexual orientation, gender identity or disability is
prohibited. This prohibition shall apply to the hiring and treatment of the awarded entity’s
employees and to all subcontracts.
As such, each entity submitting under this notice shall include a provision wherein the
submitting entity, or entities, affirms in writing it will not discriminate on the basis of race,
color, religion, creed, sex, age, marital status, national origin, or because of actual or
perceived sexual orientation, gender identity or disability and which also recognizes the
eventual contract will contain a provision prohibiting discrimination as described above
and that this prohibition on discrimination shall apply to the hiring and treatment of the
submitting entity’s employees and to all subcontracts.
In addition, pursuant to City Commission Resolution 5169, the entity awarded a contract
under this project and any subcontractors must abide by the Equal Pay Act of 1963 and
Section 39-3-104, MCA (the Montana Equal Pay Act), and affirm it will abide by the
above and that it has visited the State of Montana Equal Pay for Equal Work “best
practices” website, https://equalpay.mt.gov/BestPractices/Employers, or equivalent
“best practices publication and has read the material.
The right is reserved to reject any or all proposals received, to waive informalities, to
postpone the award of the contract for a period of not to exceed sixty (60) days, and to
accept the lowest responsive and responsible bid which is in the best interest of the
OWNER.
