Reference Application # 20365 Complaint/Objection dated 6/28/2021 From: Julie Geyer, 5803 Staffanson Road, Bozeman 59718 Property rights are important everywhere, but especially in Montana, and I am surethat all my neighbors would agree that the Lazerewicz have every right to developtheir property. All would be fine, if in doing so, it did not infringe on the property rightsof “every” neighboring property surrounding the Lazerewicz property. According to the City of Bozeman Planning Department the Lazerewicz property is surrounded by all “County” properties and is only adjacent to the city in one point onthe northeast corner of the subject property. In reading the full definition of Montana Code Part 43 (7-2-4301) this only marginally meets the criteria to annex. It thusmakes the potentially “newly annexed” property a “donut hole” to the surrounding county properties. The proposed access roads for the new development (Armour Way and StaffansonRoad) are “privately” maintained low density county roads with 1–2 acre lot homes,which then connect to Cottonwood Road and Stucky. Sunrise Homes has advisedthat at their expense, they plan to pave, gutter, and put in sidewalks on our privatelymaintained county road. Once the improvements are made, Sunrise Homes claimthat the city will maintain the roads (at no cost to residents) although most if not allhomeowners do not plan to annex into the city. Even with the proposed improvement to the roads, the roads will not be able tosustain not only the construction traffic for this large development, but then whencompleted, the traffic from all the additional properties/residents. As an example,during regular school/work times, traffic will be backed up for at least a block withtraffic waiting to turn left onto Cottonwood and Stucky. All in all, the access roadsproposed for this proposed annexation/subdivision do not meet the “common sense”rule. The proposed extension of Kagy Boulevard will require the loss of Staffansonhomeowner’s property, and in one case the removal of a large, luxury home. Thisclearly was not well thought out. I would suggest having Kagy end at CottonwoodRoad, and then traffic continue onto Stucky Road. Reference Application #20365 Complaint/Objection dated 6/28/2021 From: Frank Geyer, 5803 Staffanson Rd, Bozeman, Mt 59718 The owner of the Lazarewicez property has the right to develop the property. The city annexation rule is a real stretch (annexation of any contingent property to city property). This property is a corner touch to another annexed city property. This would amount to checkerboard city development. This property does not have access to public roads and intends to use the Staffanson Subdivision road to access south Cottonwood road. Staffanson subdivision is low density and has a road that has forever been maintained by the residents and is not for heavy traffic use. The timing for this subdivision is premature. Currently there is no infrastructure in place for water, sewer and most important transportation. Bringing this infostructure must not impact our Staffanson roads and access to our properties. I strongly object to the Lazarewicez property development use of our private Staffanson subdivision road.
