Dear Sarah:
This letter is to provide written responses to the comments stated in the engineering review memo dated
April 3, 2020. Below are our responses associated with each comment.
ENGINEERING COMMENTS:
Easements
1.BMC 38.410.060.E – Easements. Sidewalks outside of the ROW for Technology
Boulevard West will require Public Access Easements, prior to Preliminary Plat
approval. The response from the applicant’s attorney is not sufficient. If conditions were
provided in Phase 2 and 3 to allow the sidewalks without a public access easement,
please provide them to Engineering (Anna Russell). Based on what has been submitted,
the City is requiring the easements.
Response:Public Access Easements will be provided if sidewalks are designed
outside of the dedicated ROW. Until the PRELIMINARY plat is approved we do not
know what the final design is going to be. The easements can be determined during
design and shown on the FINAL plat.
2.BMC 38.410.060.B.1.b – Easements. While Northwestern Energy has approved the
location of the 10 foot utility easements on either side of Technology Boulevard West
over the sidewalk, they also state that surface infrastructure may limit the width of the
sidewalk. The City is not in support of this. The applicant must designate easement bump
outs out of the sidewalk to accommodate transformers, electrical cans and any other
utility surface infrastructure (telephone/fiber) prior to Preliminary Plat approval. No
transformers or electrical cans can be located in landscape islands. The alternative is to
modify the easement with every Site Plan, which the City is not in support of.
Response:Since we don’t know Northwestern Energy’s design we cannot provide
easements where their equipment will be located. Once design is complete easements
can be provided either on the FINAL plat or separate documents.
Transportation
1. The provided exhibit appears to show angled parking on both sides of the street. It
appears that this was likely the intent of the subdivision. However, the main street section
in the PUD did not provide a clear description of this and did not provide a cross section
through this area. The letter from Brian Krueger only referenced angled parking adjacent
to the front of buildings. The City is currently reviewing a PUD Mod which may allow
this configuration with additional pedestrian safety measures. With this application, the
double angled parking is not supported. See below for the only section provided along
this section of roadway in the PUD most recently modified in 2018.
Response:A memo analyzing the double angle parking was emailed to Anna
Russell on April 30, 2020. Along with the memo a road cross section was also included
in the email.
Street Lighting
2.BMC 38.570.030 – Street Lighting. A Special Improvement Lighting District (SILD)
must be created prior to Final Plat approval. Note that Bozeman Gateway Site Z project
will likely be creating a SILD so adding these lights to that SILD will be acceptable.

3.BMC 38.400.080 Sidewalks. Sidewalks must be installed along the north side of
Garfield from the intersection of Harmon Stream Boulevard to the eastern boundary of
this Phase prior to Final Plat approval.
