Box 1230 Bozeman, MT 59771-1230 Re: Bozeman Gateway Ph 4 Subdivision Preliminary Plat Resubmittal COB#: 19436 MMI#: 3638.009 Dear Sarah: This letter is to provide written responses to the comments stated in the engineering review memo dated January 17, 2020. Below are our responses associated with each comment. ENGINEERING COMMENTS: Easements 1. BMC 38.410.060.E – Easements. Sidewalks outside of the ROW for Technology Boulevard West will require Public Access Easements, prior to Preliminary Plat approval. The response from the applicant to this unaddressed review comment was that the sidewalks outside of the ROW are covered under the reciprocal access easement described in the Declaration. The Declaration only allows for “lot owners, their tenants, their respective tenants, employees, customers, and invitees.” This language does not cover the public who are not patronizing the businesses. Ted’s attorney provided the following response. “The sidewalks addressed in the above comment will border, and be immediately adjacent to, Technology Boulevard West. Pedestrians will be able to access the sidewalks freely from the ROW. The Declaration ensures public access by prohibiting the construction of any barrier that would obstruct pedestrian access: “[N]o fence or other barrier which would unreasonably prevent or obstruct the passage of pedestrian or vehicular travel for the purposes permitted by this Declaration shall be erected or permitted within or across the easement areas,” except for specific allowances such as mailboxes, landscaping, curbing, and other traffic controls. This language is found on Page 12, Section 4.01(b) of the Declaration.” Also, there is existing conditions in Phase 2 and 3. Any location where there is on street angle parking and sidewalk is adjacent to the curb no easements were required other than what is specified in the Declaration. 2. BMC 38.410.060.B.1.b – Easements. The proposed 10 foot utility easements on either side of Technology Boulevard West must not be under a sidewalk. Move them back behind the sidewalk or relocate the utility easements with approval from all impacted utilities, prior to Preliminary Plat approval. If northwestern energy has approved the location, provide written documentation showing this. Correspondence with northwestern energy has been included in this resubmittal. Street Lighting 3. BMC 38.570.030 – Street Lighting. Street lights must be installed along the north side of Garfield Street from Harmon Stream Boulevard to the eastern boundary of this Phase spaced per City of Bozeman standards prior to Final Plat approval. A Special Improvement Lighting District (SILD) must be created prior to Final Plat approval. Note that Bozeman Gateway Site Z project will likely be creating a SILD so adding these lights to that SILD will be acceptable. Due to the lighting being required to be spaced at a certain distance (see the DSSP), and not wanting a patchwork of lights down a collector street, the City will not allow lighting to go in based on development of each Site Plan along the north side of W Garfield Street. An overall street light layout along Garfield Street has been included in this resubmittal. Groundwater 4. BMC 38.220.060 – Preliminary Plat Supplements. Based on the hydrograph from IR 2, the groundwater elevation is as shallow as 1 foot below existing ground surface. Therefore, no crawl spaces or basements will be permitted on this entire phase. The applicant must add the following note to the Conditions sheet of the plat: “This subdivision is in a known area of high groundwater. No crawl spaces or basements may be constructed in the development. Sump pumps may not be discharge onto streets or into curb and gutter.” The note has been added to the conditions sheet of the plat. Transportation 5. Staff reviewed all previous approved Design Development manuals and did not find any specific references to double angle parking in each direction of travel. The City Engineering Department is not approving the double angle parking on Technology Boulevard West. Technology Boulevard, referred to as Main Street in the manual, runs through Phases II, II, and IV of this Subdivision and must continue the section built in Phase II and III. This may address above review comments related to a utility easement not being permitted to run under sidewalks as well as sidewalks being outside of the ROW. Documentation has been submitted to show this configuration was previously approved in a 2014 PUD modification. 6. BMC 38.400.080 Sidewalks. Sidewalks must be installed along the north side of Garfield from the intersection of Harmon Stream Boulevard to the eastern boundary of this Phase prior to Final Plat approval. Understood.
