HomeMy WebLinkAbout20- Supplemental Agreement 1 to Modify School Resource Officer Work Schedules BOZ E MAN MT POLICE DEPARTMENT SUPPLEMENTAL AGREEMENT No. 1 TO MODIFY SCHOOL RESOURCE OFFICER (SRO)WORK SCHEDULES This Supplemental Agreement No. 1 ("Agreement") to Collective Bargaining A_greement Dated Augu&0 i'`i .2020 ("CBA") is entered into this `i'' day of 2020 between the City of Bozeman ("Employer") and the Bozeman Police Protective Association ("Association") and together with Employer the "Parties". COVID-19 Pandemic Due to the COVID-19 pandemic and subsequent closure of all schools within the Bozeman School District 7,supplemental agreement no. 1 to modify school resource officer(SRO) work schedules, did not have the full opportunity to be used as initially intended.While this was at no fault of the Employer or the Association, Bozeman School District 7 has expressed the modified SRO schedule has been a positive experience. The Employer and the Association agree,the complete implications of supplemental agreement no. 1 have not been met due to the on- going school closure. The Parties agree as follows: 1. Purpose. In accordance with the CBA,alternative shifts may be agreed to by the parties in writing. See Article 5- Hours of Work&Overtime; Section C- Regularly scheduled Shifts;Subsection 2: "Alternative shift(s) as agreed upon by the Association and Employer. Alternative shifts may impact Article 5,Sections A and F and will be agreed upon in writing." In keeping with the City's Strategic Plan,this Agreement to modify the School Resource Officers' ("SRO") work schedule is entered into for purposes of providing better service to community schools,enhancing the partnership between the schools,the City of Bozeman and the Bozeman Police Department, strengthening relationships between students and the Bozeman Police Department,attracting qualified Police Officers to serve as SROs,to provide a positive reduction in the crime rate associated with truancy,and to most effectively manage police resources. This schedule replicates,as much as possible,the school's calendar to ensure,to the extent possible,that an SRO is available during the school's class and/or activity hours. 2. Term. This Agreement will be in effect for the 2020-2021 school year,according Bozeman, MT 59771-1230 TDD: 406-582-2301 THE MOST LIVABLE PLACE. BOZ E MAN MT POLICE DEPARTMENT to the Schools'official academic calendar ("School Calendar"attached hereto as Exhibit A and incorporated herein),unless otherwise modified as described in this Agreement.This agreement will be reevaluated during the summer of 2021. Furthermore,the Employer and the Association agree this schedule is only necessary should in-person learning be offered five (5) days a week. If Bozeman School District 7 adopts an in-person learning plan that is less than five (5) days a week,the Employer and the Association shall meet to re-evaluate the need for the supplemental agreement. Management has the right to discontinue this alternative schedule at any time and for any reason and return to the current schedule as defined in the CBA. 3. Article 5 is amended as follows: a� Alternative Shifts for SROs. SROs will be assigned a work schedule of five (5) days a week, Monday through Friday,nine (9) hours per duty day. The SRO shift will be 7:30 a.m.-4:30 p.m. Sections of Article 5 not addressed here remain unchanged. l� Overtime. Overtime shall be paid for work hours over eight (8) hours per duty day.The Association and the Employer agree every hour of earned overtime will be converted to compensatory time at the rate of time and one- half. c) Holidays. SROs will be granted Special Holiday Leave for all City-recognized holidays when, according to the School Calendar, there are no classes scheduled. SROs will not be scheduled to work during the Thanksgiving Break,Winter Break(December 23,2019-January 3,2020),or Spring Break (March 16-20, 2020),as designated on the School Calendar,and will use accrued compensatory or vacation time to cover the weekdays that are not City- recognized holidays. d) PIR days. There are days designated as "PIR Days"and"P/T Conferences" days during the school year. If the SROs are not providing training to the District,the following options are available at the discretion of the Police Chief, Division Commander,or the SRO's supervisor: i. SROs may be assigned to work at another school,provided that school has classes and is not being covered by the assigned SRO otherwise, ii. The accrual period for compensatory time will be the day "School Begins"as designated on the School Calendar. For SROs,the maximum compensatory time balance from one school year to the next is 225 hours. SROs are encouraged to be in school when school is in session. If an SRO leaves the SRO Program,the accrual period for purposes of calculating the maximum accrual balance of 225 hours will end on December 31St of that year. 5. Any SRO not willing to agree to terms of this Agreement will be removed from the SRO Program and reassigned by the Employer where needed. 6. SROs are responsible to maintain certifications and complete Department required training including the months outside the school year. 7. All terms of the CBA not specifically modified by this Amendment remain in effect. It witness whereof,the parties have set their hands this It day of_� ao 2020.
