GRANTEE,itssuccessorsand assigns,a perpetualeasement to lay,constructand maintain sewer
and water pipelineswith theusual services,valves,connections,accessoriesand appurtenances
forthe purpose of transmitting saidservicesin.through.and acrossa stripof land situatedin
GallatinCounty.Montana,30 feetwide to be locatedon the followingdescribedrealproperty:
Lot 1.Block 6 of The Cottonwood Subdivision.accordingtothe officialplaton
fileinthe officeof theclerkand recorderof GallatinCounty,Montana .under Document No.
The easement ismore particularlydescribedon the attachedExhibit(s)A and B which by
thisreferenceare made a parthereof.
This grantincludesthe rightoftheGRANTEE.itssuccessors.permittees.licensees.and
assignsand itsand theiragentsand employees.toenteratalltimes upon the above-described
land by using existingroads or trailsor otherwiseby a routecausing the leastdamage and
inconvenience to theGRANTOR(S)in orderto survey and establishtherouteand locationof the
easement and the pipelineand to:
(1)Construct.operate.patrol.repair,substitute.remove,enlarge,replace,and maintain the
pipeline.services,connections,accessoriesand appurtenances:
(2)Trim,remove,destroy.or otherwisecontrolany treesand brush insideor outsidethe
boundaries of the easement which may,intheopinion of the GRANTEE.interfereor
threatento interferewith or be hazardous to theconstruction.operationand maintenance
of the pipeline;
(3)Grade the land subjectto thiseasement and extend the cutsand fillsof thisgrading into
and on the land adjacentto thatwhich issubjecttothiscasement to theextentGRANTEE
may findreasonablynecessary;and
(4)Support thepipelineacrossravinesand water courses with structureswhich GRANTEE
deems necessary.
TI IE GRANTEE AGREES:
(l)That.inconnection with theconstruction.operating,patrolling.repairing.substituting,
removing.enlarging.replacing,and maintainingof saidpipeline(s),itwillrepairor
replace.at itssoleexpense,or pay to GRANTOR(S)the reasonablevalue of any damages
any damages togrowing crops.existingfences,ditchesand otherappurtenancesof said
land thatmay be disturbedby itsoperation.
(2)That.during operationsinvolvingexcavation,itwillremove thetopsoilfrom the trenched
areato a depth of one foot,or to the fulldepth of the topsoil.whichever isless,and
stockpilesaidtop soilforreplacement over thetrench.Itwillremove from the siteany
largerocks or surplusexcavating materialor any debristhatmay have been exposed by
theexcavationand remains afterbackfillingiscompleted.And.itwillleavethe finished
surfaceinsubstantiallythesame conditionas existedpriorto the beginning of operations
except thatthe surfaceof backfilledareasmay be mounded sufficientlyto preventthe
formationof depressionsafterfinalsettlementhas taken place.
11IE GRANTOR(S)AGREES:
(l)At no time willthey build,construct,erector maintain any permanent structurewithin the
boundaries of saideasement withoutthepriorwrittenconsent of GRANTEE.
(2)At no time willthey modify the finishedgrade of the land over the pipelineby removal of
existingsoilor by placement of fillmaterialwithin theboundaries of saideasement
without the priorwrittenconsent of theGRANTEE.
(3)That where thesubjectimprovements arenot locatedunder improved publicor private
streetsor otherprovided access.a 12 footwide all-weatheraccess road may be
constructedwithin theeasement where attheCity'sdiscretionsuch accessisrequiredfor
operationand maintenance purposes.
(4)The GRANTOR(S)warrantsthatthey are lawfullyseizedand possessed of the real
propertydescribedabove,thatthey have a lawfulrighttoconvey the property,or any part
of it,and thatthey willforeverdefend the titleto thispropertyagainsttheclaims of all
persons.
(5)The GRANTEE may peaceably hold and enjoy therightsand privilegeshereingranted
without any interruptionby the GRANTOR(S).The terms.covenants and provisionsof
thiseasement and agreement shallextend to and be binding upon theheirs,executors.
administrators,personalrepresentatives.successorsand assignsof the partieshereto.
