HomeMy WebLinkAbout3.11_Draft Waiver of right to protest SID 12-18-2020 WAIVER OF RIGHT TO PROTEST CREATION OF SPECIAL IMPROVEMENT DISTRICTS FOR BOZEMAN EAST MIXED-USE, LOT 5 AT BRIDGER PEAKS VILLAGE SUB FOR VALUABLE CONSIDERATION, the undersigned, being the Owners of the hereinafter described real property, do hereby waive the right to protest the formation of one or more Special Improvement District(s) for: a. Street improvements to Tschache Lane including paving, curb/gutter, sidewalk, and storm drainage b. Street improvements to N. 15th Avenue including paving, curb/gutter, sidewalk, and storm drainage c. Intersection improvements to Tschache and N. 19th Avenue This Waiver and Agreement is independent from all other agreements and is supported by sufficient independent consideration to which the undersigned are parties and shall run with the land and shall be binding upon the undersigned, their successors and assigns, and the same shall be recorded in the office of the County Clerk and Recorder of Gallatin County, Montana. An SID or alternate financing method for the completion of said improvements shall include consideration of any prior contributions to existing improvements made by current or previous owners of the subject site. In the event an SID is not utilized for the completion of these improvements, the developer agrees to participate in an alternate financing method for the completion of said improvements on a fair share, proportionate basis as determined by square footage of property, taxable valuation of the property, traffic contribution from the development or a combination thereof. The real property hereinabove mentioned is more particularly described as follows: Lot 5 of The Bridger Peaks Village Subdivision situated in the NW ¼ of Section 1, Township 2 South, Range 5 East, P.M.M.
