HomeMy WebLinkAbout3.13.3_Drainage Easement_2021-03-19 DRAINAGE EASEMENT Saccoccia Lands II LLC , GRANTOR, in consideration of One Dollar ($1.00) and other good and valuable consideration, receipt of which is acknowledged, grants to the Bridger Peaks LLC, a Montana limited liability company registered to conduct business in the state of Montana with address c/o H&S Financial Corp. P.O. Box 2028, Sun Valley Idaho, 83353 hereinafter (“GRANTEE”), its successors and assigns, an easement for public drainage purposes, in, through and across the following described real property situated in Gallatin County, Montana, more particularly described as follows and on the attached Exhibit "F": 20’-Wide Storm Easement all within Lot 5 of Bridger Peaks Village Subdivision, Plat J-368, Situated in the NW1/4 of Section 1, Township 2 South, Range 5 East, Principal Meridian, City of Bozeman, Gallatin County, Montana. The GRANTOR warrants that it is lawfully seized and possessed of the real property described above, that it has lawful right to convey the property, or any part of it, and that it will forever defend the title of the property against the claims of all persons. The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the rights and privileges herein granted without any interruption by the GRANTOR. The terms, covenants and provisions of the easement and agreement shall extend to and be binding upon the heirs, executors, administrators, personal representatives, successors and assigns of the parties hereto.
