BOZEMAN EAST MIXED-USE DEPARTURE REQUEST The Owner’s are requesting a departure from code section 38.510.030 Block Frontage Standard Section I. See attached Departure Exhibit for additional information. Code Requirement: 38.510.030 (I) Trail/park frontages. Where a property fronts onto a park or a public trail, such frontages must comply with the mixed block frontage standards set forth in subsection D of this section. For non-residential developments/uses where the review authority determines that an orientation to the trail would not be appropriate based on the context of the site, the development must be subject to the standards for "other block frontages" set forth in subsection G above, with a minimum building setback of 20 feet from the applicable park/trail right-of-way, easement, or property line. Departure Request: Allow parking adjacent to Trail/Park in-lieu of a Building. Justification The buildings are located on site to create a sense of community and encourage interaction between the residents various buildings. They are centrally located near the primary on-site amenities such as the courtyard and pedestrian right-of-way easement. Additionally, the are near the mixed-use buildings to encourage use and activate these commercial spaces. Moving a building to the east would mean placing parking between buildings 2/B and 3/C which would create separation and be less safe as residents would have to cross parking lots and drive aisles to get to community amenities. Mitigation: A minimum of 5.5 feet and maximum of 80 feet of landscape buffer is provided between the trail and any parking. This area is landscaped with large shrubs to provide future screening of the parking from the trail system. Where the trail is actually adjacent to the proposed dedicated parkland there is a minimum of 20 feet of landscape buffer. Amenities such as a community garden and dog off-lease area are located between the trail and the parking lot proving ample separation between the uses.
