Yes, that works. Will take a closer look upon submittal of the MSP. I’m assuming the developer will be implementing
indoor efficiency measures, pursuant to a water adequacy agreement, to reduce the CILWR amount? If yes, we’ll need
the agmt finalized and signed prior to MSP approval.

Brian –
The planning number is #19230/19231 – the MSP and Ph 1 site plan are being submitted together and
reviewed concurrently. The landscaping plan is attached with the IWR bubbled. We don’t quite have the
commercial use nailed down but I have the gross square footages for each commercial space in EX 1
attached. Once I have a better idea of the commercial uses I will let you know, for now I will attach our
correspondence in our site plan application resubmittal with the understanding we will get the payment to you
before site plan approval. Let me know if that works thanks!

What’s the planning file number for this project and where is at in the review process? Are the MSP and Ph1 Site Plan
being submitted and reviewed concurrently? Is the landscaping plan finalized with an IWR known? The design report is
for the water/sewer extension using DEQ demand factors that aren’t appropriate for CIL water rights determination
since they overestimate the anticipated water demand significantly. Try to nail down the general categories of
commercial use and the proposed gross square footages for each. I’ll draft the CILWR agmt once I have all the necessary
information to assemble it. It will need to be signed prior to MSP approval and will identify CILWR payments for each
phase.

Hi Brian –
Sorry it’s been a while on this project! We are finally getting started up again – I used your template for
Flanders Mill to put together an CIL estimate that includes the residential, commercial and outdoor portion of
the project. For the commercial part, we aren’t quite sure of the uses yet so I used the estimate for ADF that
we calculated in the Water Report for the city (attached). The owner is wanting to use high efficiency fixtures
and irrigation as well so if it would be possible to draft and agreement that would be great! Let me know if you
need anything else from me.

We need to do some work to hone in on the final CILWR amount. Few things to keep in mind that haven’t been
accounted for in the fee worksheet provided.
- Need to include demand for the commercial space. What uses are proposed and square area for each? (e.g. sq
ft of office, retail, restaurant, etc.)
- The property is located in the Bozeman solvent site CGWA, so it must use city water for landscape
irrigation. The irrigation demand must be included in the final fee. The demand will be taken from the
landscape plan sheets
- This is a MSP development, so if it’s being built in phases, CILWR will be paid in phases. We can figure out the
fee per phase if you break out the unit counts, commercial space, and landscape demand per phase.
- Because of the high unit count for this development, the city offers a CILWR fee reduction of ~20% if certain high
efficiency fixtures/appliances are installed. This reduction is rolled into a separate agreement that must be
signed prior to MSP approval. Does each unit have its own W/D? The fee reduction comes back to the
developer at the end of the project as a rebate once we confirm that the agreed high efficiency products were
installed. Can consider reductions for high efficiency irrigation componentry if there’s a reasonable means of
reducing water beyond what’s currently been spec’d for the irrigation system. The CILWR agreement will have
baseline amounts to pay for each phase, the respective rebates, and the process to get the rebates money back.
If the fee reduction agreement is something the developer wants to pursue, then let me know and I can work on a draft
agmt. An example is provided. If not, then please provide the information requested above re: commercial space and
irrigation demand.
