CONCURRENT CONSTRUCTION REQUEST

The applicant’s intention is to apply for issuance of a building permit prior to completion of the public
infrastructure as identified under Section 38.270.030 (Completion of Improvements) of the City of
Bozeman Unified Development Code. This request applies to the development of the Bozeman East
Mixed Use Site Plan.
This request is to allow building construction on the subject property concurrently to construction of
North 15th Avenue from Patrick Street and Tschache Lane and Tschache Lane from its existing
terminus to the connection to North 15th Avenue. As such, the applicant requests the issuance of a
building permit prior to off-site improvements being completed for the site. The improvements in
North 15th Avenue will include the installation water, sewer, storm, curb and gutter, sidewalk, and
street infrastructure. Prior to commencement of construction for both on and off site improvements,
the applicant shall obtain all necessary approvals and permits from the City of Bozeman, and the
Montana Department of Environmental Quality. It is anticipated that improvements in North 15th
Avenue will be completed well before the construction of the buildings is complete, however the
applicant understands that all necessary improvements must be completed and accepted by the City
prior to a Certificate of Occupancy being issued for the development.
Responses to the specific criteria from Section 38.270.030 for concurrent construction for site
development are noted below:
1. Provision of municipal central water distribution, municipal sanitary sewer collection systems, and streets means
that the criteria in either subsection a or subsections b and c are met as follows:
Response: The concurrent construction being requested follows the criteria in
subsections b and c. Responses to the subsections are noted below:
C.1.b. The water mains, sewer mains, and streets to be extended to provide service to the development are:
located within a publicly dedicated right-of-way or easement; constructed to city standards, are physically adjacent
to the site proposed for construction, are installed and accepted by the city, and are adequate in capacity to
provide necessary service to the proposed development; and comply with the requirements of this subsection C.1.b
and subsection C.1.c of this section;

Response:
· The existing roadway improvements for Tschache Lane are located in a public
street and utility easement. See the attached Bridger Peaks Village Subdivision
Plat J-368 for details.
· The proposed roadway improvements for the extension of Tschache Lane and
North 15th Avenue will be installed in the existing public street and utility
easement. See the attached PT Land Phase 2 Subdivision Plat J-498 for details.
· All improvements will be constructed to City standards. Approvals from the
City of Bozeman, and the Montana Department of Environmental Quality will
be obtained before the commencement of construction.
· The roadway improvements are located adjacent to the site.
· The improvements would be installed by the developer and would ultimately
be accepted by the City. The developer will work with the City on all necessary
inspections and provide as-built documents to ensure compliance with City
standards.
· Adequate water and sanitary sewer capacity are available to serve the
development. A complete water and sewer design report has been submitted
with this application.
· The responses to the requirements of subsection C.1.b are noted above and
subsection C.1.c are noted below
C.1.c Water mains, sewer mains and streets must meet the following requirements:
(1) Any required on-site extensions of water mains, sewer mains or streets to be dedicated to the public must
be located entirely within publicly held easements or rights-of-way; must serve only a single lot; are the
subject of an irrevocable offer of dedication to the city upon completion of the project, the development is
under the control of a single developer who must retain control of the entire project until final completion;
all work is under the supervision of single general contractor; and no subdivision of land is involved;
Response:
· The existing roadway improvements for Tschache Lane are located in a public
street and utility easement. See the attached Bridger Peaks Village Subdivision
Plat J-368 for details.
· The proposed roadway improvements for the extension of Tschache Lane and
North 15th Avenue will be installed in the existing public street and utility
easement. See the attached PT Land Phase 2 Subdivision Plat J-498 for details.
· The concurrent construction improvements only serve Lot 5, Bridger
Peaks Village Subdivision.
· An irrevocable offer of dedication to the city will be provided by the developer
upon completion.
· The development is under the control of a single developer, who will
maintain control of the entire project until final construction completion
and beyond.
· All of the work associated with the project, both on-site and off-site, will be
under the supervision of one general contractor.

· No subdivision of Lot 5, Bridger Peaks Village Subdivision is proposed with
this application.
(2) The DRC must determine when the standards of this subsection C.1 are met. The fire department must
consider whether adequate fire protection services are available from existing hydrants, and water supply
exists to meet needs during construction. If adequate fire protection does not exist then concurrent
infrastructure and building construction may only occur under the provisions of subsection C.1.c(3) of this
section. Based on evaluation by the fire department, simultaneous construction of infrastructure to be
dedicated to the public and private construction may be permitted only within a defined portion of the site;
Response: There are (6) existing fire hydrants currently surrounding the property.
Several hydrant locations are located near the site within allowable hose length
dimensions. See the attached exhibit showing the hydrant locations. Fire
Department access is provided from Tschache Lane, the service lane on the back
side of the Bridger Peaks Town Center, and North 15th Avenue.
(3) Approval of the final engineering design, including location and grade, for the infrastructure project must
be obtained from the engineering department, and the state department of environmental quality when
applicable, prior to the issuance of any building permit for the development;
Response: Approval of final engineering design from the City of Bozeman and
the Montana Department of Environmental will be obtained prior to building
permit issuance.
(4) No occupancy, either temporary or final, may be issued until all on-site and off-site water, sewer and
street or drive improvements are installed and accepted or approved as applicable by the City.
Response: The developer understands the no occupancy, either temporary or
final, may be issued until all on-site and off-site water and sewer improvements
are installed and accepted or approved by the City.
