Planner Chris Saunders presented a staff report on floodplain regulations where he outlined plans for Ordinance 2057 Floodplain Update Text Amendment which included timelines and changes proposed for the ordinance. Planner Saunders disclosed that there was one comment made by a member of the Bozeman Planning Board / Zoning Commission Meeting Minutes, 02-01-21 Page 2 of 4 public in agreement with the amendment. Planner Saunders recommended that the Floodplain Update Text Amendment meets the criteria for approval. City of Bozeman Floodplain Engineer Brian Heaston presented to the board the importance of floodplain regulations, the benefits of floodplains to the natural infrastructure of the city and the designation of regulated flood hazard areas as they pertain to FEMA, the state and the city. Engineer Heaston reported that the ordinance received preliminary approval from FEMA and DNRC. 00:59:45 Board Questions The board directed questions to the presenters regarding the City's plans for prevention and mitigation of flooding as well as public provisions for structures located in and near the floodplain. 01:56:45 Public Comment Opportunity Ryan Krueger (509 S. 20th) suggested an opportunity for Mr. Heaston to share his presentation with the development community and help give them an idea on what the next steps are for this particular issue. 02:07:59 Meeting turned over to Zoning Commission Chair, Chris Scott 02:09:10 Motion Recommended Zoning Commission Motion: Having reviewed and considered the staff report, application materials, public comment, and all information presented, I hereby adopt the findings presented in the staff report for application 20136 and move to recommend approval of Ordinance 2057. Mark Genito: Motion Nicole Olmstead: 2nd 02:09:44 Discussion Board Member Genito spoke to his motion, stating that he will be supporting the motion. Board Member Olmstead spoke to her second agreeing with Mark Genito and stating that she will be supporting the motion. Chairman Scott added that he is in favor of the amendment and will be supporting the motion. Board Member Shelkey added that she will be supporting the motion. Commissioner Madgic recommended that members make sure the motion takes into account the criteria and that it's meeting the Bozeman Strategic Plan, the Growth Policy, Zoning Criteria and other City criteria. Chairman Scott responded to Commissioner Madgic stating that he will adopt all the findings made in the staff report as his own. 02:14:55 Vote on the Motion Recommended Zoning Commission Motion: Having reviewed and considered the staff report, application materials, public comment, and all information presented, I hereby adopt the Bozeman Planning Board / Zoning Commission Meeting Minutes, 02-01-21 Page 3 of 4 findings presented in the staff report for application 20136 and move to recommend approval of Ordinance 2057. The Motion carried 4 - 0 Approve: Nicole Olmstead Mark Genito Kirsa Shelkey Christopher Scott Disapprove: None 02:15:04 Meeting turned back over to Planning Board Chair, Henry Happel. 02:15:32 Motion Recommended Planning Board Motion: Having reviewed and considered the staff report, application materials, public comment, and all information presented, I hereby adopt the findings presented in the staff report for application 20136 and move to recommend approval of Ordinance 2057. Gerald Pape: Motion Richard Rudnicki: 2nd 02:15:54 Discussion Board member Pape spoke to his motion stating that staff findings were well met and he would be supporting the motion. Chairman Happel spoke in agreement with the findings in the staff report and stated that he will be supporting the motion. 02:19:18 Motion to amend Board Member Egge proposed a friendly amendment which modifies section 38.410.100, by striking the water course set-back section of the code, acknowledging that the floodplain development requirements would fulfill the same purpose and acknowledging a desire to maintain a simple, implementable, interpretable code. Mark Egge: Motion The motion did not receive a second and was lost 02:21:12 Vote on the Motion Recommended Planning Board Motion: Having reviewed and considered the staff report, application materials, public comment, and all information presented, I hereby adopt the findings presented in the staff report for application 20136 and move to recommend approval of Ordinance 2057.
