Planner Chris Saunders presented a staff report on floodplain regulations where he outlined plans for Ordinance 2057 Floodplain Update Text Amendment which included timelines and changes proposed for the ordinance. Planner Saunders disclosed that there was one comment made by a member of the 4 Bozeman Planning Board / Zoning Commission Meeting Minutes, 02-01-21 Page 2 of 4 public in agreement with the amendment. Planner Saunders recommended that the Floodplain Update Text Amendment meets the criteria for approval. City of Bozeman Floodplain Engineer Brian Heaston presented to the board the importance of floodplain regulations, the benefits of floodplains to the natural infrastructure of the city and the designation of regulated flood hazard areas as they pertain to FEMA, the state and the city. Board Member Olmstead spoke to her second agreeing with Mark Genito and stating that she will be supporting the motion. Chairman Scott added that he is in favor of the amendment and will be supporting the motion. Board Member Shelkey added that she will be supporting the motion. Commissioner Madgic recommended that members make sure the motion takes into account the criteria and that it's meeting the Bozeman Strategic Plan, the Growth Policy, Zoning Criteria and other City criteria. This board generally meets the 2nd and 4th Monday of each month from 6:00 PM to 8:00 PM 7 Memorandum REPORT TO:Planning Board FROM:Tanya Andreasen, Community Housing Manager Marty Matsen, Community Development Director SUBJECT:"Bozeman Code Audit to Create and Preserve Housing" Presentation and discussion with consultant MEETING DATE:April 26, 2021 AGENDA ITEM TYPE:Citizen Advisory Board/Commission RECOMMENDATION:none STRATEGIC PLAN:4.5 Housing and Transportation Choices: Vigorously encourage, through a wide variety of actions, the development of sustainable and lasting housing options for underserved individuals and families and improve mobility options that accommodate all travel modes. BACKGROUND:The City of Bozeman’s Community Housing Needs Assessment was completed in early 2019, and the Community Housing Action Plan (Action Plan) accepted early in 2020. These guiding documents are the basis for a community partnership framework that advances cross agency and organization collaborations to address housing issues in Bozeman. The City of Bozeman’s Community Housing Program is the convener of these diverse partners, and takes the lead on researching and implementing many of the strategies of the Action Plan. One of the Action Plan strategies addresses the reduction or elimination of “regulatory barriers” in City policies. The City has teamed up with Clarion Associates to undertake a code analysis and draft recommendations for changes to the City of Bozeman’s Unified Development Code (UDC) that will help ensure that the City of Bozeman’s land use policies encourage, incentivize, and expedite affordable housing construction and preservation, thereby increasing housing stock across the continuum of housing need while remaining in balance with other community priorities. Particular attention will be paid to the code section regulating Planned Unit Developments. Further, and in a second phase of work, the City seeks a review of its Affordable Housing Ordinance, Bozeman Municipal Code Section 38.380 (AHO), and propose amendments that meet the City’s identified goals in the Community Housing Action Plan. Analysis and retooling of the complex policies and technical requirements of affordable home development and preservation will be improved by accessing the ideas and concerns of the people who have expertise in our community as developers, service providers, builders, investors, renters and 8 homeowners, employers, lenders, realtors, and the City's citizen advisory board members involved with land use policy and housing affordability. There will be engagement of stakeholders and community members in two phases, as well as online engagement on the City's webpage for this project: Phase 1, Spring 2021: Review the Unified Development Code including the Planned Unit Development (PUD) regulations to recommend changes that encourage the expansion of affordable housing in Bozeman. Phase 2, Summer 2021: Review and recommend amendments to the Affordable Housing Ordinance. Per municipal code, Section 38.260.030, the Zoning Commission and or Planning Board must hold one or more public hearings when text amendments may be proposed affecting zoning provisions and/or subdivisions. This initial discussion session with the consultant team will serve to introduce the project, present initial findings by the consultant team, and invite discussion of duplicity, gaps, dissonance, lack of clarity, and barriers to affordable home development in the City's Unified Development Code. Subsequent meetings will be planned for this same joint body to review recommended changes to the Affordable Housing Ordinance particularly. The final recommendations from both phases of the project will be presented at a third joint session with the Zoning Commission, Planning Board, attendees, staff, and the consultant team. The goal of the analysis is to end up with recommended text amendments and operational changes for the City to consider that instead encourage, incentivize, and expedite affordable home development and preservation. A four-Step Process in which the Clarion Team will work collaboratively with the public, staff, stakeholders, and elected/appointed officials through the remainder of 2021 to encourage the preservation and creation of affordable housing through: 1. Recommended text for revising the City’s PUD regulations; 2. Recommended text for revising the City’s Affordable Housing Ordinance; and 3. Detailed recommendations for revising the rest of Chapter 38 (the Unified Development Code). Task 1 starts with an initial round of engagement. There will be additional rounds of engagement to review draft recommendations in Tasks 2 and 3, and final recommendations in Step 4. Questions to Think About for this First Meeting The Unified Development Code influences the affordability of housing through rules about: • What land uses and types of buildings are allowed in each part of the city; • What levels of site and building quality are required; and • What procedures are required to engage the community and make development decisions. 1. What new types of housing -- or mixed-use development that includes housing – should be easier to construct in different zoning districts throughout the city? Ideas often discussed in other communities include Tiny Houses, Accessory Dwelling Units, Duplexes, Triplexes, Fourplexes, Attached Rowhouse/Townhouses, and multistory Multi-family buildings. 2. Are there any current site and building design requirements that add more to the cost of housing than they add benefits to the community? Topics that could be discussed include building height and intensity limits, maximum lot coverages, minimum parking, required landscaping and buffering, detailed building design requirements, lighting regulations, and site access and connectivity standards. 3. Are there any parts of the development review and approval process that regularly result in denial of housing projects or reduction of proposed housing units? Topics sometimes discussed include public hearing requirements, vague or conflicting approval criteria, excessive or unduly burdensome conditions or approval, or easy appeals. 10
