This land is now part of the county and is in a rural agriculture land with three sides of the land agriculture in nature. The Road that the land to be annexed is next to on the west is a gravel county road it then T’s into a paved county road to the east it does not join on to a city street until Kurk drive with out a jog and kurk drive is an unfinished city street with a side walk on only one side and no bicycle lanes a turn on to 27th street is required to access Graf Street, winding thru a single family residences. 2. As the staff made map below shows the land to the North an r-4 annexed land on Stucky Road to the North and east of this proposal has not been developed with a requirement that Stucky must be brought to city standard from its western boarder to 19th the other r-4 is connected to Graf Street an already developed city collector street it has side walks, bike lanes and it is connected to 19th. 3.As shown on the map below this is a peninsula of annexation with only one side of land with connectivity to Bozeman and only one city street that is not an arterial or collector st. Fowler is a county unimproved Road that is not up to city standards, as noted by the r-4 on stucky and on Graf Street. 4.Bozeman's Annexation Policy(5076) No.6 The City of Bozeman encourages annexations to the make the city boundaries more regular rather than creating irregular extensions which leave unannexed gaps between annexed areas or islands of annexed or unannexed land. No. 7 The City of Bozeman encourages annexations which will enhance the existing traffic circulation system or provide for circulation system that do not exist at the present time. This does not enhance the traffic circulation. Section 2 No.3. The application for annexation must be in conformance with the current Bozeman growth policy or community plan. Section 2 No.7. It is the policy of the city that annexations will not be approved where unpaved county roads will be the most commonly used route to gain access to the property unless the landowner proposed a method to provide for construction of the road to city standards So the city is saying that in the future Fowler Lane will be brought up to city standards this could be years and this does not follow this annexation rule even if the rest of fowler lane is county road it should apply, rather the cities infrastructure should be in place. 8.R-4 Zoning: 9. Former Gallatin County Commissioner, Mr. Don Seifert speaking at a Bozeman Zoning Commission Meeting on 11 January 2021, said in regards to the Buffalo Run application: “It is significantly, significantly different from the prevailing land uses in the area.” “There is one land owner, one land owner that will benefit from this. I think the finding on that is very clear.” “This is special legislation that is not going to benefit surrounding land owners.” 10. Bozeman Community plan: Is this annexation of r-4 a walkable development or a Drive-Drive-Drive liability? Theme 5. Transportation systems in the following: 1.Livability-in-terms of traffic congestion,but also noise, pollution, physical activity,accessibility,safety,and aesthetics. 2. Affordability-after housing, transportation is the second largest expense for most households. ( this annexation will be all about driving) 3.Sustaninablity-transportation accounted for more than one-third of Bozeman’s 2016 greenhouse gas emissions, can you imagine what it is now. 11.
