It is my respectful hope that you will visit this location in person prior to the meeting to see for yourself how terribly wrong an R-4 zoning designation would be for this property. The property, which fronts Fowler Road (a county dirt road with ditches on either side) is in the middle of agricultural land. It is a peninsula and while the surrounding properties may, eventually be annexed into the City, we are told by the present owners they have no intention of requesting annexation. All property owners adjacent to this property have protested this application. We understand the need for additional housing in Bozeman and we are NOT NIMBY’s. We are concerned about allowing far too many (NOT AFFORDABLE) high-end condos in an area that is NOT walkable, is NOT bikeable, is NOT near shopping, churches, schools, restaurants, businesses with NO public transportation opportunities anywhere near it. This developer’s initial R-5 application included 13 buildings with 288 units. The proposal was to funnel all the traffic generated by the residents of Buffalo Run through the Meadow Creek Subdivision on roads that are NOT collectors or arterials. The submitted traffic study they (done during Covid lockdown) estimated 1200+ vehicle trips per day to and from Buffalo Run. Please keep in mind that there are only 180 homes in Meadow Creek at the current time with 3 vacant lots remaining. After public outcry, the developer withdrew his application for R-5 and resubmitted for R-4. The developer claims there is no firm construction plan for these 20.79 acres. He has stated that he needs to put as many units as he can on this land to make money and his R-4 application continues to show a similar street layout as the original application. I think it’s fair to say that he still plans to build 288 units which translates into 1200+ vehicle trips per day. He also changed one ingress/egress to Fowler Lane—but kept the other on Kurk, a local subdivision street through Meadow Creek, 33 feet wide without bike lanes or a sidewalk on the north side of the street. We have been told the developer will “pave” Fowler Lane to Stucky Road but not to City standards. There won’t be any bike lanes or sidewalk, there will be ditches on either side, a dangerous situation. Stucky Road is another county road, essentially a dirt road topped with blacktop--not built to City standards—with ditches on either side, NO bike lanes or sidewalks. This is a nightmare waiting to happen. At what point and who will be responsible for bringing Fowler up to City standards. The developer will be long gone. Is this another lawsuit waiting to happen with the County about who will pay for what? Will City residents and others (Meadow Creek) be required to pay a SID tax to make the improvements? Isn’t this making the developer’s problem the City of Bozeman and the residents of Meadow Creek’s problem? The traffic pattern proposed by the developer through the Meadow Creek Subdivision is unsafe and untenable. The traffic pattern on Fowler to Stucky is unsafe and untenable. I respectfully ask that you deny this application until such time as the proper infrastructure can be installed for the sake of the City and the residents of Meadow Creek—not to mention the safety of the potential residents of Buffalo Run. Let’s think long-term and try to solve the Bozeman housing problem without causing headaches to the City and the County—especially for a project that will only house folks who don’t need affordable housing.
