WARRANTY DEED
FOR VALUE RECEIVED, THE COTTONWOOD PROJECT, LLC, a Delaware limited
liability company of 3112 Los Feliz Boulevard, Los Angeles, California 90039, the
GRANTOR, does hereby grant, bargain, sell, convey and confirm unto CITY OF
BOZEMAN, a Montana municipal corporation, with a mailing address of P.O. Box 1230,
Bozeman, Montana 59771-1230, the GRANTEE, the following described real property
situated in Gallatin County, Montana, to-wit:
City Park Lot 1, Block 4, Phase 1 ; City Park Lot 1, Block 5, Phase 1 ; City
Park Lot 1, Block 6, Phase 1 ; and City Park Lot 1, Block 7, Phase 1 of the
Final Plat of Cottonwood Subdivision Phase 1 & 2, a subdivision of Tract
3A-1 of Minor Subdivision No. 454C, located in the NW'/4 of Section 15,
Township 2 South, Range 5 East, P.M.M., City of Bozeman, Gallatin
County, Montana, according to the official plat thereof on file and of record
in the office of the Clerk and Recorder of Gallatin County, Montana. (Plat
Reference: J-685 )
TOGETHER with all the tenements, hereditaments and appurtenances thereto
belonging, and the reversion and reversions, remainder and remainders, rents, issues
and profits thereof; and also all the estate, right, title, interest, property, possession,
claim and demand whatsoever, as well in law as in equity, of the GRANTOR;
TO HAVE AND TO HOLD the said property, together with all tenements, hereditaments
and appurtenances unto GRANTEE and its heirs, successors and assigns forever.
GRANTOR does hereby covenant to and with GRANTEE that it is the owner in fee
simple of said property; that it is free from all encumbrances except rights-of-way,
federal patents and mineral reservations, easements, and building and use restrictions
of record; that GRANTEE shall enjoy said property without any lawful disturbance; that
GRANTOR will, on demand, execute and deliver to GRANTEE, at the expense of
GRANTEE, any further assurance of the same that may be reasonably required; and
that GRANTOR will forever WARRANT and DEFEND all right, title and interest in and
to the said property unto the GRANTEE, its successors and assigns, against all and
every person or persons whomsoever lawfully claiming or to claim the same.
