My opposition centers on the fact that the R-4 zoning description is inappropriate for this area: “is appropriate for areas adjacent to mixed-use districts, commercial districts, and/or served by transit to accommodate a higher density of residents in close proximity to jobs and service” (Bozeman Code of Ordinances, Sec. 38.300.100, E). It makes sense that they pulled the R-5 zoning application, but this R-4 zoning application is in fact no better because it is too high density to be adjacent to Meadow Creek and send a considerable amount of traffic through this neighborhood that people have chosen as small and quiet. It will no longer be safe or quiet if Buffalo Run goes in as an R-4. And it’s certainly too high a density for agricultural residents on Fowler. My opposition remains steadfast for this zoning because this piece of land is not adjacent to commercial districts, is not on a bus line, and is not close to jobs or services. It meets none of the guidelines for R-4. The closest grocery store is Town and Country on 11th, and you can’t walk there since it’s too far and much of 19th is unpaved. Enterprise you can’t even count as commercial since it’s largely condos and the climbing gym and defunct Oracle, so to pretend that is a commercial zone people might go to is absurd. Additionally, R-4s allow medical marijuana facilities and other business facilities that would change the whole character of this peaceful neighborhood. While the developers say they mean to pave Fowler from that property to Stuckey along county standards, there’s no guarantee that’ll happen, and it’s clear the bulk of the traffic from this development will come through Meadow Creek and dramatically increase the traffic on Kurk. Kurk is a small neighborhood road, and the numbers of people that would use it for driving access to W. Graf would be dangerous, loud and out of character with this neighborhood, which is a Zone 3 operating as a Zone 1. I think a R-2 or R-3 makes sense for Buffalo. Run. I attended the meeting the developer had with residents after they pulled their R-5 application, and it’s clear they simply want to make as much money as possible by doing as high density of a building plan as possible, while pretending they won’t to us residents to get us to go along with them. Opposing this sort of spot zoning is critical because this area along 19th is going to get developed, and it needs to be done well for our current lifestyle and existing neighborhoods here in Bozeman.
