RELEASE AND RECONVEYANCE OF EASEMENTS
COMES NOW the City of Bozeman,121 N.Rouse Ave,MT 59715,a Municipal
Corporation of the Stateof Montana hereinafter("GRANTOR")and does hereby releaseand
reconvey the following described easement unto Í3e7-am ßoolchr_kLC ,as
follows:
WITNES S ETH
WHEREAS the Grantor isthelegalrecordtitleholderofa 25-footPublicAccess Easement
situatedon Lots 1,2 &7 ofBlock 21 CattailCreek SubdivisionPhase 3,Cityof Bozeman,Gallatin
County,Montana.
WHEREAS the above utilityeasement was grantedby the followinginstrument:
Public Access Easement,of record (Document No.2248527),recorded on November
17'h,2006 at the Clerk and Recorder's Office of Gallatin County,Montana.
WHEREAS no publicutilitiesare locatedwithintheeasements to be releasedand the
vacation of the said easements will not adversely impact the Grantor'sor the Public utility
companies interests.
WHEREFORE,the Grantor does hereby releaseand reconvey to B.2m SylderLLC
thoseportionsofthe accesseasement locatedon theabove describedrealpropertyas setforthon
the Exhibit attachedheretotogetherwith any right,title,or interestthattheGrantor may have in
saidaccesseasement as setforthon theaforementioned Exhibitattachedheretoand incorporated
hereinby referenceas though fullysetforthand shown on the aforementioned Exhibit.

(1)To constructandmaintainthedrivewayandparkingareaattheirown expensein
accordancewithrelevantCityOrdinances,including,butnotlimitedto,snowremoval
andallmajorandminorrepairwork.
(2)To allowtheCitytomakeanyandallinspectionsofthedrivewayandparkingareaand
landappurtenanttheretoastheCityreasonablydeemsnecessary.
TheGRANTOR warrantsthattheyarelawfullyseizedandpossessedoftherealproperty
describedabove,thattheyhavealawfulrighttoconveytheproperty,oranypartofit,and
thattheywillforeverdefendthetitletothispropertyagainsttheclaimsofallpersons.
TheGRANTOR furtheragreesthattheGRANTEE may peaceablyholdandenjoythe
rightsandprivilegeshereingrantedwithoutanyinterruptionbytheGRANTOR,Theterms,
covenantsandprovisionsofthiscasementshallextendtoandbebindingupontheheirs,
