F. Action Items
1. 06:01:53 PM (00:02:09) 2504 W. Mendenhall Annexation (#19462) (Saunders)
The proposed annexation of a 1/3 acre lot with a duplex on it on the corner of 25th and
Mendenhall. Only requesting to connect to sewer at this time. This item was continued from the
December 10th Zoning Commission meeting. No changes to the application materials or staff
report.

Community Development Manager Chris Saunders presented an overview of the proposed
annexation and zoning request. The property has two residences on the parcel and the property has
a failed septic system. A part of the requirements to connect with the city sewer system is
annexation and zoning. There were no public comments received for this proposal.
Mr. Saunders answered questions from the Zoning Commission members the reasons why R-3 was
requested and not R-2. Mr. Saunders also said that upon annexation approval, the existing septic
system would be removed and abandoned. The proposal will go in front of the City Commissioners
on January 13, 2020.
06:08:01 PM (00:08:17) Tanner Skelton, owner of the property presented his situation. He is
reluctantly asking for annexation because of a catastrophic failure of the septic system. He felt
financially driven to make this decision, but was still financially impacted with the required fees
associated with the annexation/zoning request. He does not wish to abandon his well, but
understands that it is part of state/federal law about only using his well for irrigation. He also felt
that the zoning of R-3 would fit with the city growth policy.

06:14:16 PM (00:14:32) Mr. Saunders clarified the reason for separation of the well from the city
system. Mr. Saunders also clarified that the applicant paid cash in lieu of turning his water rights
over to the city.
06:15:50 PM (00:16:06) MOTION: Having reviewed and considered the staff report, application
materials, public comment, and all information presented, I hereby adopt the findings presented in
the staff report for application 19462 and move to recommend approval of the 2504 W Mendenhall
Street Zone Map Amendment, with contingencies required to complete the application processing.

1. Other Updates
Mr. Saunders informed that the building where the Planning department is located would be under
remodel for the next five to six months. The department may a little more congested and noisy than
usual. It should not modify any packet schedules.
Commission members asked Mr. Saunders the status of implementing the “suggest a change”
community platform for the public to recommend changes to the city code. Mr. Saunders said that the
website is up and available. The website is located under City Projects/UDC Community Platform. The
website does show the suggestions already submitted and when they will be considered. The plan is for
staff to look at the input two times a year to see what code changes can be made to improve the city
code.
