1. Variance Request by Ryan Elliott, Beatty Road, Tract 2 of COS 2624, SW ¼ of Section 19, Township 2 South and Range 5
East, Bozeman, Gallatin County, Montana
a. 2020-030: To construct a wastewater treatment system using a sealed component (transport line) that
comes within 50 feet of surface water (Dry Creek). This transport line is proposed to perpendicularly cross
Dry Creek.
2. Variance Request by Rick & Nancy Rosenthal, 500 Hamilton Road, COS 842, W1/2, NE1/4, Section 30, Township 1
North, Range 5 East, Belgrade, Gallatin County, Montana
a. 2020-018: To construct a wastewater treatment system in a location that is less than 100 feet to a floodplain.
The system will be located about 33 feet outside the floodplain.
b. 2020-029: To construct a wastewater treatment system in a location that does not have 52 inches of natural
undisturbed soil to the groundwater. The system proposed will have 46 inches of natural soil, 4 inches of
disturbed soil, and 12 inches of sand below the distribution piping.
3. Variance Request by Phillip Johnson 15580 Crowley Lane, Lot 1 of COS 2599, Madison River Valley, NE1/4 of
Section 21, Township 1 North, Range 2 East, Logan, Gallatin County, Montana
a. 2021-002: To construct a wastewater treatment system in a location that is less than 100 feet to a floodplain.
The system will be located about 5 feet outside the floodplain.
4. Variance Request by Thomas and Judy Tyler, 64070 Gallatin Road, Tract 17 of Castle Rock Tracts (Record E-45),
Section 33, Township 4 South, Range 4 East, Gallatin Gateway, Gallatin County, Montana
a. 2021-003: To construct a wastewater treatment system using a sealed component (transport line) that
comes within 50 feet of the property owner’s drinking water well. The transport line is proposed to be as
close as 15 feet to the well location

a. 2020-028: To construct an elevated sand mound with less than 4 ft. of vertical separation to seasonally high
