HomeMy WebLinkAbout05-27-20 Correspondence - Delisting from CECRA Priority List Montana DepartmentAA I�11 N-1 Qh.. of Environmental Quality May 27,2020 Mayor Chris Mehl and the Bozeman City Council 121 North Rouse Avenue Bozeman,MT 59715 Subject: Developmental Technologies Facility—Proposed Delisting from CECRA Priority List Dear Mayor Mehl and Council Members: In accordance with ARM 17.55.114(1)(b), the Montana Department of Environmental Quality (DEQ) has published notice in the Bozeman Daily Chronicle of a 30-day public comment period on its proposal to delist the Developmental Technologies Facility (Facility) in Bozeman, Montana, from the Comprehensive Environmental Cleanup and Responsibility Act (CECRA) Priority List. In February 2019, the Montana Department of Environmental Quality (DEQ) finalized a Phase U Environmental Site Assessment (ESA) of the Facility. The ESA identified one contaminant of potential concern, benzo(a)pyrene, which exceeded the Montana Tier 1 Risk-Based Corrective Action (RBCA) Guidance for Petroleum Releases residential direct contact risk-based screening level. However,the one soil sample did not exceed the RBCA Tier 2 residential screening levels.No samples exceeded any other generic screening levels in surface,subsurface,or groundwater samples. Therefore,DEQ determined it was appropriate to initiate the delisting procedure under ARM 17.55.114(1)(b)to remove the above-referenced Facility from the CECRA Priority List. As provided for in ARM 17.55.114(6)(c), DEQ is notifying you as well as the Gallatin County Commissioners and the Gallatin County Health Department. The public comment period on this proposed delisting will begin on June 5,2020,and written comments must be received in the DEQ office by midnight on July 5,2020. Copies of site-related documents are available at the DEQ Waste Management and Remediation office located at 1225 Cedar St. in Helena. DEQ will hold a public meeting upon written request to DEQ on or before June 5,2020, by 10 or more persons, a group of 10 or more persons,or by a local governing body of a city,town,or county. Comments received through the postal service must be postmarked no later than July 5,2020, " and comments submitted electronically must be received no later than 11:59 pm MST on July 5,2020.
