UTILITY EASEMENT
NORTH PARK DEVELOPMENT PARTNERS, LLC, GRANTOR, in consideration of
One Dollar($1.00) and for other and valuable considerations, receipt of which is acknowledged,
grants to THE CITY OF BOZEMAN, a municipal corporation of the State of Montana, with
offices at 121 North Rouse Avenue, Bozeman, Montana 59715, GRANTEE, its successors and
assigns, a perpetual utility easement for the use of each and every person, firm or corporation,
whether public or private,providing or offering to provide telephone, electric power, gas,
internet, cable television or other similar utility or service, the right to the joint use of an
easement for the construction, maintenance, repair, and removal of their lines and other facilities,
in, through, and across a strip of land situated in Gallatin County, Montana, ten (10) feet wide to
be located on the following described real property:
Tract 4-A of Certificate of Survey No. 2153, located in the Northeast One-Quarter and
the Northwest One-Quarter of Section 36, 'Township 1 South, Range 5 East, Principal
Meridian Montana, City of Bozeman, Gallatin County, Montana.
The easement is more particularly described on the attached Exhibit"A"which by this
reference is made a part hereof.
The GRANTOR states that it possesses the real property described above and that it has a
lawful right to grant an easement thereon.
The GRANTOR further agrees that the GRANTEE may peaceably hold and enjoy the

rights and privileges herein granted without any interruption by the GRANTOR.
The terms, covenants, and provisions of this easement shall extend to and be binding
upon the heirs, executors, administrators, personal representatives, successors, and assigns of the
parties hereto.

LEGAL DESCRIPTION
The following is a description of the centerline of a ninety foot (90.00)
wide Public Road and Utility Easement and a ten foot (10.00) wide
utility easement, situated within Tract 4—A of Certificate of Survey No.
2153, located in the Northeast One—Quarter and the Northwest
One—Quarter of Section 36, Township 1 South, Range 5 East, Principal
Meridian Montana, City of Bozeman, Gallatin County, Montana. Said
Public Road and Utility Easement centerline being more particularly
described as follows:
Beginning at a point which bears North 88`08'35" West, a distance of
19.62 feet from the Center One—Quarter Corner of said Section 36;
thence along a 300.00 foot radius non—tangent curve to the left
through a central angle of 33`09'50" for an arc length of 173.65 feet,
with a chord bearing of North 33°42'48" West a distance of 171.23
feet;
thence North 50`20'11" West a distance of 249.98 feet, to a point
being the center of a 100.00 foot radius cul—de—sac.
Said Public Road and Utility Easement being 60,852 square feet.
