Engineering Memo Comments:
EASEMENTS:
1. Bozeman Municipal Code (BMC) 38.400.090.C.3.c. Drive Access Requirements – The
applicant must provide the mutual access easement through the emergency vehicle
turnaround area prior to site plan approval.
RESPONSE: An access easement document is forthcoming.
2. BMC 38.410.060 Easements – The applicant must provide the proposed public drainage
easement. The easement must be provided using the City’s standard language and
reviewed and approved by the Engineering Department. The applicant should contact the
Engineering Department to receive a copy of the City’s standard language. Once approved
the applicant must provide an executed original easement prior to site plan approval.
3.
RESPONSE: A drainage easement document is forthcoming.
4. BMC 38.410.060 Easements – The applicant must provide the proposed public trail
easement for the shared ‐use path. The easement must be provided using the City ’s
standard language and reviewed and approved by the Engineering Department. The
applicant should contact the Engineering Department to receive a copy of the City’s
standard language. Once approved the applicant must provide an executed original
easement prior to site plan approval.
RESPONSE: A trail easement document is forthcoming.
STORMWATER:
1. BMC 38.410.080. Grading and Drainage
a. Engineering Design Report Appendix A Storm Water Design Calculations – The
calculations in the drainage report do not include all of the regraded contributing
area. The applicant must include the pond areas and all other regraded areas in the
calculations.
RESPONSE: The stormwater design calculations have been revised to include
all pond surfaces and regraded contributing areas – See Design Report
Appendix A.
b. Civil Design Drawings Sheet C4.2 – It is not clear where the overflow discharge
goes after exiting the short drainage ditch. Please note if the discharge enters an
existing swale that carries runoff around the building.
RESPONSE: After retaining the design storm, pond overflow from larger storm
events and some run-off from unaffected existing areas will follow the existing
flow path around the north side of the building – See note added to sheet C4.2.
c. Civil Design Drawings Sheet C4.1 – The applicant must indicate where the
retention pond on the northwest portion of the site will overflow and where that
overflow discharge will be directed.
RESPONSE: After retaining the design storm, overflow from the NW retention
pond will be directed via stabilized rock weir and drainage ditch to an existing
swale on the east side of the trail that flows north and eventually enters the
roadside ditch near the intersection of Deadman’s Gulch and N. 19 th Ave. – See
notes added to sheet C4.1.

t dhengineering.c om
d. Civil Design Drawings Sheet C4.3 – The overflow discharge from the retention
pond on the southwest portion of the site looks as though it will impact the adjacent
trails. These impacts must be mitigated prior site plan approval.
RESPONSE: A culvert has been added to convey overflows from the SW
retention pond under the connecting trail and the reconstructed N-S trail will
include a drainage ditch along it’s east edge to convey flows to an existing
swale at the NW corner of the site – See notes added to sheet C4.3 and trail
section widening detail 7/C5.1.
WATER RIGHTS:
1. BMC 38.410.130 Water Rights ‐ Payment of twenty four thousand dollars for cash ‐in ‐lieu
of water rights is required prior to site plan approval.
RESPONSE: Acknowledged
WATER:
1. BMC 38.410.070. Municipal water, sanitary sewer and storm sewer systems ‐
Landscape Design Drawings Sheet L2.0 – The note indicates the irrigation water will be
from the existing well. Please revise this to match the engineering report that states the well
will not be used for irrigation at this time.
RESPONSE: The note on Sheet L2.0 has been revised to identify the City water
system as the irrigation water source.
WASTEWATER:
1. BMC 38.410.070. Municipal water, sanitary sewer and storm sewer systems ‐ DSSP
Section (V) (B) – The applicant must submit an estimate and calculations for the existing
and proposed peak ‐hour and average daily sewer flows generated by the facility.
RESPONSE: Existing and proposed sewer flow calculations for the project have been
added to the engineering design report.
TRANSPORTATION:
1. BMC 38.400.050 ‐ Street and road right ‐of ‐way width and construction standards ‐
The applicant requested a departure from providing the additional five feet of right ‐of ‐way
along the project side of Orville Way. This departure request is denied. The applicant must
provide an additional five feet of right ‐of ‐way along the project side of Orville Way prior to
site plan approval.
RESPONSE: An additional 5-feet of right-of-way will be provided by a new public
street and utility easement along the project frontage – See sheets C3.0, C3.1, C3.2,
and C4.7. A 31-foot street width is acceptable for Orville Way per City Engineering
email dated December 3, 2020. An easement document is forthcoming.
CONDITIONS OF APPROVAL:
1. SID Waiver – If not already filed for the subject site, the applicant must provide and file with
the County Clerk and Recorder's office executed Waivers of Right to Protest Creation of
Special Improvement Districts (SID’s) for the following:

b. Intersection improvements to North 19th Avenue and Cattail Street/Deadman’s
Gulch and Simmental Way and Baxter Lane.
See attached SID waiver to be signed and notarized by the applicant. Provide a copy of the
recorded SID waiver prior to Site Plan approval.
RESPONSE: See response to DRC Memo Conditions of Approval Item 4.
ENGINEERING ADVISORY COMMENTS:
1. Care should be taken with snow storage placement in the retention ponds and around inlets
to prevent unwanted ponding caused by inlets being plugged with snow and ice.
RESPONSE: Acknowledged – the project storm water maintenance plan also
mentions to inspect for snow and ice buildup regularly and to avoid piling snow over
inlets.
2. The City will be performing work on the trail immediately south of the project. Please
coordinate tie ‐in with the Engineering Department (Taylor Lonsdale).
RESPONSE: Acknowledged – the trail tie-in will be coordinated with Mr. Lonsdale
prior to initiating construction.
3. Plans and Specifications for streets and storm water improvements to Orville Way and
Simmental Way, prepared and signed by a professional engineer (PE) registered in the
State of Montana, must be provided to and approved by the City Engineer. The applicant
shall also provide professional engineering services for construction inspection, post ‐
construction certification, and preparation of mylar record drawings. Construction shall not
be initiated on the public infrastructure improvements until the plans and specifications have
been approved and a preconstruction conference has been conducted. Building permits
will not be issued prior to City acceptance of the infrastructure improvements unless
all provisions set forth in Section 38.270.030.C of the Bozeman Municipal Code are
met to allow for concurrent construction. The project is eligible for concurrent
construction of the public infrastructure and proposed structures. If the applicant wishes to
request concurrent construction for the public infrastructure associated with the project
(water and sewer mains) the following items are required:
a. Formal memo requesting concurrent construction
b. Plan and specification approval from the City and State prior to issuance of building
permit(s).
c. Submittal of an executed original conditional irrevocable offer of dedication, please
contact the Engineering Department to receive a copy of this document.
d. Written approval from the fire department for concurrent construction.
If concurrent construction is requested after the site plan has been approved a modification
application will be required.
RESPONSE: Plans and Specifications will be provided to City Engineering review and
approval of the proposed public improvements. This project will be requesting
concurrent construction as part of this site plan application – a formal memo
addressing the required items is forthcoming.
