December 23, 2020 - DRC Memo Comments:
Section 2 – Conditions of Approval
3. Provide a copy of the recorded SID waiver prior to Site Plan approval. If not already filed for the
subject site, the applicant must provide and file with the County Clerk and Recorder’s office
executed Waivers of Right to Protest Creation of Special Improvement Districts (SID’s) for the
following:
a. Street improvements to Simmental Way and North 19th Avenue including paving,
curb/gutter, sidewalk, and storm drainage.
b. Intersection Improvements to North 19th Avenue and Cattail Street/Deadman’s Gulch and
Simmental Way and Baxter Lane.
See attached SID waiver to be signed and notarized by the applicant.
RESPONSE: Acknowledged – a copy of the fully executed and recorded SID waiver
document will be provided for site plan approval.
Section 3 – Required Code Corrections
PLANNING COMMENTS:
2. Site Design – Section 38.520.040.C.4 - Pedestrian paths through parking lots. Developments
must provide specially marked or paved sidewalks through parking areas. At least one walkway
must be provided every four rows of parking or at a maximum spacing of 200 feet. The pathways
must provide a safe connection to the building entrance and meet the pathway design standards set
forth in subsection D. The proposed parking area exceeds 200-feet in length and width and a
walkway through the parking area must be provided. Partially Addressed – Provide details on
crosswalk materials per 38.520.040.C.3. Preformed thermoplastic must be inlaid not overlaid.
RESPONSE: Crosswalk marking callouts have been revised to say “inlaid thermoplastic”
with materials per City Standard Specification Sections 02581 and 02582– See sheets C3.1
and C3.3.
4. Parking – BMC 38.540.020.M - Snow removal storage areas may not be placed in such a
manner as to damage landscaping. The additional landscape screening provided for the south
parking lot should be relocated to be west of the snow storage provided between the shrubs
and trees. Basically, swap the locations of the shrubs along the west side of the parking lot
with the snow storage area to protect the landscaping from future snow removal damage.
RESPONSE: Landscape screening locations for the south parking lot have been moved west
of the snow storage areas – See Landscape Plans.

December 29, 2020 - Engineering Memo Comments:
EASEMENTS:
1. Bozeman Municipal Code (BMC) 38.400.090.C.3.c. Drive Access Requirements – The
applicant must provide the mutual access easement through the emergency vehicle
turnaround area prior to site plan approval.
RESPONSE: A draft public access easement is provided with the site plan resubmittal
materials. The owner-executed easement will be provided prior to site plan approval.
2. BMC 38.410.060 Easements – The applicant must provide the proposed public drainage
easement. The easement must be provided using the City’s standard language and
reviewed and approved by the Engineering Department. The applicant should contact the
Engineering Department to receive a copy of the City’s standard language. Once approved
the applicant must provide an executed original easement prior to site plan approval.
RESPONSE: A draft public drainage easement is provided with the site plan
resubmittal materials. The owner-executed easement will be provided prior to site
plan approval.
3. BMC 38.410.060 Easements – The applicant must provide the proposed public trail
easement for the shared‐use path. The easement must be provided using the City ’s
standard language and reviewed and approved by the Engineering Department. The
applicant should contact the Engineering Department to receive a copy of the City’s
standard language. Once approved the applicant must provide an executed original
easement prior to site plan approval.
RESPONSE: A draft public trail easement is provided with the site plan resubmittal
materials. The owner-executed easement will be provided prior to site plan approval.
STORMWATER:
1. BMC 38.410.080. Grading and Drainage
a. The applicant must direct the drainage along the trail from the detention ponds under
the trail to the ditch on the west side of the trail or the applicant must provide
documentation demonstrating the applicant has an easement from the neighboring
property to the north for site runoff to be conveyed to the neighboring property’s
stormwater basin.
RESPONSE: The drawings have been revised to include a drainage chase to
direct site runoff to the west side of the trail prior to exiting the property – See
sheets C3.1 and C4.1.
WATER RIGHTS:
1. BMC 38.410.130 Water Rights ‐ Payment of twenty four thousand dollars for cash‐in‐lieu
of water rights is required prior to site plan approval.
RESPONSE: Acknowledged

TRANSPORTATION:
1. BMC 38.400.050 ‐ Street and road right‐of‐way width and construction standards ‐
The applicant requested a departure from providing the additional five feet of right‐of‐way
along the project side of Orville Way. This departure request is denied. The applicant must
provide an additional five feet of right‐of‐way along the project side of Orville Way prior to
site plan approval.
RESPONSE: A draft public street and utility easement is provided with the site plan
resubmittal materials. The owner-executed easement will be provided prior to site
plan approval.
CONDITIONS OF APPROVAL:
1. SID Waiver – If not already filed for the subject site, the applicant must provide and file with

RESPONSE: See response to DRC Memo Conditions of Approval Item 3.
ENGINEERING ADVISORY COMMENTS:
1. Care should be taken with snow storage placement in the retention ponds and around inlets
to prevent unwanted ponding caused by inlets being plugged with snow and ice.
RESPONSE: Acknowledged – the project storm water maintenance plan also
mentions to inspect for snow and ice buildup regularly and to avoid piling snow over
inlets.
2. The City will be performing work on the trail immediately south of the project. Please
coordinate tie‐in with the Engineering Department (Taylor Lonsdale).
RESPONSE: Acknowledged – coordination with Mr. Lonsdale for the trail tie in has
been initiated and will be ongoing as both projects near construction.
3. Plans and Specifications for streets and storm water improvements to Orville Way and
Simmental Way, prepared and signed by a professional engineer (PE) registered in the
State of Montana, must be provided to and approved by the City Engineer. The applicant
shall also provide professional engineering services for construction inspection, post ‐
construction certification, and preparation of mylar record drawings. Construction shall not
be initiated on the public infrastructure improvements until the plans and specifications have
been approved and a preconstruction conference has been conducted. Building permits
will not be issued prior to City acceptance of the infrastructure improvements unless
all provisions set forth in Section 38.270.030.C of the Bozeman Municipal Code are
met to allow for concurrent construction. The project is eligible for concurrent
construction of the public infrastructure and proposed structures. If the applicant wishes to

request concurrent construction for the public infrastructure associated with the project
(water and sewer mains) the following items are required:
a. Formal memo requesting concurrent construction
b. Plan and specification approval from the City and State prior to issuance of building
permit(s).
c. Submittal of an executed original conditional irrevocable offer of dedication, please
contact the Engineering Department to receive a copy of this document.
d. Written approval from the fire department for concurrent construction.
If concurrent construction is requested after the site plan has been approved a modification
application will be required.
RESPONSE: A formal memo requesting concurrent construction for this project is
provided with the site plan resubmittal materials. Additionally:
• Plans and specifications for the public infrastructure improvements are being
submitted to the City Engineering Department.
• A draft original conditional irrevocable offer of dedication is provided with the
site plan resubmittal materials. The owner-executed document is forthcoming.
• Written approval from the Fire Department has been requested and will be
provided following site plan approval.
