1. 08:17:47 AM (00:23:34) CAHAB discussion of City of Bozeman Engineering Design
Standards Review scoping process. CAHAB will finalize a list of ideas related to housing
affordability to be forwarded to staff for consideration in the writing of the scope of work
for the selected consultant team, Morrison Maierle – DOWL.

Board member Noel Seeburg shared that he felt modifying Engineering design standards would not make a large
enough impact on affordability. He shared that he felt the major obstacles include review time, and cost of
materials.

08:22:08 AM (00:27:55) Board member Greg Stratton echoed board member Seeburg’s statement and read an
excerpt from Morrison Maierle’s proposal which stated they’d look for reasonable areas to offer relaxations to
lower infrastructure costs. Mr. Stratton asked that the board take a broader approach and focus on what they
can do procedurally. Board members David Magistrelli, and Hannah Van Wetter agreed.
08:28:00 AM (00:33:47) Chairman Thane shared that his intention was to request that specific items be
examined in the process of reviewing engineering standards.
08:34:14 AM (00:40:00) Community Housing Program Manager, Tanya Andreasen, pointed out that they are in
the scoping process and that there will be opportunities to discuss ideas and offer input. Chairman Thane
supported the idea of having the consultants present at future CAHAB meetings for discussion.
Suggested Motion:
Having reviewed the materials provided, I move to approve CAHAB’s recommendations as discussed and
memorialized by staff for inclusion in the scope of work that initiates a review of City Engineering Design
Standards to identify potential changes that could reduce barriers and encourage affordable residential
development and preservation.

Andreasen to represent their sentiments as a member of the scoping committee.
G. Discussion
1. 08:50:59 AM (00:56:46) CAHAB member progress reports on information and resources
they are gathering to provide basis for discussion and recommendation to staff on
including condominiums in the scope of the Affordable Housing Ordinance. Discussion
will include using square footage of developed homes as a means of calculating
affordable housing requirements. Next steps for this project will be discussed.

Board Chairman Kevin Thane introduced the discussion item, asking for board member feedback regarding using
square footage as a means of calculating affordable housing requirements. Board member Greg Stratton asked
that the board allow freedom to developers in selecting the type of affordable housing they provide within a
project, including condos and apartments. Mr. Seeburg shared that he has heard some feedback where
developers work to avoid affordable housing requirements.
2. 09:04:49 AM (01:10:35) Clarification of the City’s upcoming policy review projects,
including an audit of the Unified Development Code, as well as a review/update of city
policies as they relate to affordable housing.

09:06:13 AM (01:12:00) Ms. Andreasen provided an update on the three processes within the affordable
housing action plan: 1) reducing barriers, 2) engineering design standards review, 3) cleanup / audit of Unified
Development Code (UDC).
09:11:44 AM (01:17:31) Discussion of a CAHAB recommendation to the City Commission to approve 7
mills for the Community Housing Fund in the FY22 Budget.
Chairman Thane introduced the agenda item and asked for feedback from board members. Board member
David Magistrelli voiced support.
09:14:13 AM (01:20:00) Commissioner Terry Cunningham spoke about funding requests and the fact that they
may be dealing with a “shrinking pie” if property taxes are lowered. Chairman Thane argued that the board
should lobby for these funds to be a priority, as they are in the City’s Strategic Plan, and Community Plan.

RECOMMENDATION: The board shall vote on all nominations for the positions of Chair and Vice
Chair of the CAHAB. The positions are filled with the majority vote of the
board. The position of Secretary may be elected, although the City staff
liaison and other City staff currently fill that role as per the Board Procedures
linked in this memo.

Community Housing Fund, resulting in a recommendation to the City
Manager for the final proposed budget.

Having reviewed the packet materials and considered today's discussion, I
move to recommend that the City Manager's proposed budget funds the
Community Housing Fund at $XX for fiscal year 2022.
STRATEGIC PLAN: 1.2 Community Engagement: Broaden and deepen engagement of the
community in city government, innovating methods for inviting input from
the community and stakeholders.
BACKGROUND: Members of the board have suggested that the Community Housing Fund be
funded at 7 mills, or a particular dollar amount, for fiscal year 2022. The
revenue streams for the Community Housing Fund are limited to General
Fund dollars (3 mills for FY 2021), as well as some revenues that are
dependent on the private decisions of developers to pay cash in lieu of built
affordable homes, and subsidy recapture upon the sale of an affordable
home (so far this has not occurred so no funds have been received via this
means).
The board members wish to discuss fund expenditures and City priorities
around community housing, and the implications of making a larger
allocation to this fund in the coming fiscal year 2022. The board may make a
recommendation to City staff and City Commission as a result of this
discussion.
UNRESOLVED ISSUES: none
ALTERNATIVES: The board could recommend more or less that the amount equal to 7 mills
(or particular dollar amount), or not make any recommendation at all at this
meeting, at the body's discretion.

FISCAL EFFECTS: The recommendation does not create an immediate fiscal impact on the
functioning of the board, however as it is within the board's purview to
make funding recommendations from the Community Housing Fund, the
outcome of the City Commission's ultimate decision to approve the City
Manager's recommended FY 2022 budget will influence the activities of the
board in the future.

Community Housing Fund Allocation Process & Priorities
Community Housing Fund Philosophy: The intent City of Bozeman Community Housing Fund is to create
more housing units in Bozeman through investment that provides a demonstrably significant return on
the investment of the funds provided from the Community Housing Fund. In order to provide the
greatest impact possible, funds may be accumulated over several years. Funds may be used to support
projects large or small, as long as the impact of the project on Community Housing is significant and
provides a valuable return on investment for the Bozeman Community.
The following describes the allocation process and priorities for the City of Bozeman’s Community
Housing Fund.
Available Funding Determination:
Prior to each fiscal year, Community Development Department and CAHAB will review the following
information to determine available funding from the Community Housing Fund for the coming fiscal
year:
Available Funds & Projected Revenues:
1. Carry-Over Fund Balance:
a. Remaining uncommitted funds from previous fiscal year.
2. Additional General Funds budgeted for Community Housing Fund For Coming Fiscal Year.
Projected Expenditures:
1. Projected Contracted Services:
2. Community Housing Fund Obligations & Projections:
a. Community Housing Manager salary & expenses.
b. Committed consulting services.
c. Anticipated consulting services not yet awarded.
d. Commission-approved projects from prior year not yet expended.
e. Commission-approved projects for next fiscal year.
f. CAHAB recommended projects for next fiscal year.
Available Funds:
1. Projected revenues minus projected expenses = available funds for the coming fiscal year.
Fund Allocation Process:
During the City’s budget development cycle the Community Development Department and CAHAB will
collaborate in the preparation of the budget revenue and expense line items to be submitted for
inclusion as a part of the City’s Community Housing Fund for the upcoming Fiscal Year. Allocation of
funds will be based on the priorities detailed below and each request will be evaluated using the
Community Housing Fund Proposal Scoring Methodology. Proposals for the use of unallocated funds
will be reviewed by CAHAB and City Staff as they are received using the Community Housing Fund
Proposal Scoring Methodology and may be recommended to the City Commission for funding during the
current fiscal year.

Fund Allocation Priorities:
The City of Bozeman will use the following criteria to allocate available funds from the Community
Housing Fund. When multiple projects are before CAHAB projects scoring the highest in the Community
Housing scoring process will be given priority.
1. Down-Payment Assistance & Impact Fee Reimbursement Funds: Each fiscal year, based on
anticipated requirements for down payment assistance, impact fee reimbursement, and
Community Housing strategies for the coming fiscal year, an amount will be budgeted, if
available funds exist, from the Community Housing Fund to ensure there is adequate funding for
units developed under the city’s inclusionary zoning ordinance. At the discretion of the City
Commission this set aside may be changed at any time during the fiscal year when it is
determined that the need for down payment assistance or impact fee reimbursement will not
require these funds, the need for down payment assistance or impact fee reimbursement is
greater than anticipated, or the goal of increasing community housing would be better served
by using the funds in some other manner.
2. Low-Interest Loans or No-Interest Loans: Low or no interest loans will be offered, if funds exist,
to projects that provide or facilitate the provision of housing affordable to those making less
than 80% of the area median income. The city’s preference is to offer such loans in lieu of non-
reimbursable project funding whenever possible in order to ensure the long-term viability of the
fund. Loan stipulations would include the following:
a. Funding would require that the property be deed restricted for the term of the loan plus
five years.
b. Loans will be made available for not more that 50% of the total project cost.
c. Interest rates for general projects would be equal to the current interest rate available
to the City when financing capital projects.
d. Non-profit and governmental agencies would not be expected to pay interest.
e. Example; the owner of a house could borrow funds for an ADU at a lower than market
rate and the program would get a deed restricted unit.
f. Example; HRDC could borrow money from the fund with no interest to purchase
property or for construction funding.
3. Low-Income Tax Credit or Deed Restricted Grants: Grant funding may be made available, if
funds exist, for low income tax credit projects or other deed restricted housing projects serving
those making less than 70% of the area median income at a one to one match.
a. Additional funding may be made available through low-interest loans as described
above.
4. Land Acquisition for Community Land Trust: Grant or loan funding will be made available, if
such funds exist, for the acquisition of land that has the necessary restrictions to ensure the
affordability of dwelling units in perpetuity.
5. Grants for Infrastructure: Grant or loan funding will be made available, if such funds exist, for
the design and / or construction of infrastructure that would provide a direct benefit to the
creation of community housing.
6. Housing Preservation: Grant or loan funding will be made available, if such funds exist, for such
other projects that demonstrate a significant positive impact on the creation or preservation of
community housing.

7. Innovative Projects or Ideas: Funding may be provided, if available, for projects, processes, or
procedures that demonstrate a significant return on investment that advances the creation of
Community Housing in Bozeman.

community in city government, innovating methods for inviting input from
the community and stakeholders.
BACKGROUND: The Montana State Legislature is currently in its 67th session. There are a
number of issues before them that influence housing affordability policy,
community housing programming, funding for affordable homes, and more.
The City of Bozeman has organized a legislative affairs committee and point
person for the organization, as well as a lobbyist team, to track activities
during the 2021 session.
The City of Bozeman adopted affordable housing as one of the city’s top
three priorities at the legislature. Bozeman has chosen to join the Montana
Housing Coalition, an advocacy group which works to advance affordable
housing policy at the State Capitol. One of the bills they are supporting is HB
21 An Act Authorizing the Use of the Coal Trust Fund money for multifamily
housing. This legislation is similar to a bill that passed last session. It was a
popular piece of legislation and is expected to have broad support again. The
Housing Coalition allow supports legislation to create a workforce housing
tax credit similar to the federal LITC for the creation of low- or middle-
income housing.
There are a few pieces of legislation currently proposed that may alter state
law relating to inclusionary zoning and other zoning ordinances. They are
being monitored closely and more will be known when bill text is officially
introduced.

community in city government, innovating methods for inviting input from
the community and stakeholders.
BACKGROUND: CAHAB member Hannah Van Wetter would like to introduction of the
concept of a more structured roadmap and goals setting to help
contextualize broader mission of CAHAB to City Commission and other
Citizen Advisory Boards. The goal of this is to ensure that action items and
discussion points shared within CAHAB align with the wider goal of the City
of Bozeman to ensure affordability in housing.

information to the community and our partners.
BACKGROUND: CAHAB members work and volunteer in various public and private sectors in
our community. Monthly or periodic reports or updates from members helps
to communicate community wide work being done around housing and
housing affordability/attainability. Members wishing to give an update will
be given the opportunity at each CAHAB meeting as time permits.
