HomeMy WebLinkAboutAdministrative Order 2021-01 City of Bozeman Security Technology Policy ADMINISTRATIVE ORDER 2021 —01 City of Bozeman Security Technology Policy Purpose The City of Bozeman uses camera, audio, and video recording technology in a number of ways to promote public safety,protect public property,reduce crime and increase efficiencies. The City Manager adopts this policy in an effort to promote transparency, ensure constitutional protections of the citizens of Bozeman, and provide city departments and staff with direction regarding the use of i such technology. I'. Definition and Scope "Security technology"for the purposes of this policy is defined as technologies equipped to monitor, capture, store,transmit and/or share data, including audio, video,visual images, or other personally identifiable information which may include the time, date, and geographic location where the data was captured. Examples of security technology include security cameras monitoring city buildings, license plate readers, drones, etc. Constitutional considerations: All security technology implemented by the City of Bozeman must be used in a lawful manner consistent with the constitutions of the United States and State of Montana, and applicable State and local laws. Protecting civil liberties, including the right to privacy, equal protection and freedom of speech, of the citizens of Bozeman is of primary importance when considering whether and how to implement security technology. Each individual security technology policy must include civil liberties considerations. Security Technology used by City Departments: Each department utilizing security technology prior to the adoption of this policy shall provide the City Manager a summary of the technology currently in use. Before any department obtains and/or utilizes new security technology,the department director must provide a written summary to the City Manager, City Attorney and Information Technology Director detailing the purpose and objective for implementing the technology,the cost, and what type of data will be captured, stored, generated, or otherwise produced. The summary of each department's security technology must be provided to the City Manager on an annual basis. The IT Director may establish standards for the contents of the summary. Each department utilizing security technology must have policies in place which clearly articulate the permissible use of the technology and information collected, and how any information collected will be stored. Department directors must contact and work with the Information Technology Director and City Attorney to establish a governing policy for each technology to ensure consistency and compliance with all city policies. At minimum, each policy shall explain the purpose and objective for implementing the technology,where the technology will be deployed,the information collected,who has access to the information, and a discussion of privacy considerations. The summary of security technology maintained by the City Manager and related policies must be available to the public upon request. Training: Each department director and all city staff that installs,uses,views, and/or manages the information collected from security technology shall attend a training conducted by the City Attorney's Office and IT Department. Retention: Video, audio, or images collected by security technology shall be retained for 30 days,unless subject to an applicable retention schedule or the contents become part of an official investigation. Any video, audio, or image related to an investigation or case file shall be retained pursuant to department policy, and/or regulations regarding confidential criminal justice information. Once the 30 day retention period is met,recordings may be erased or recorded over. No disposal form is required. DATED this � Aday of JdYU , 2021 0194elielf, City Manager
