Res 5223 Intent to Rename Dead Mans Gulch to Cattail StreetMemorandum REPORT TO:City Commission FROM:Jenny Connelley, Engineering Tech Shawn Kohtz, City Engineer Mitch Reister, Director of Public Works SUBJECT:Resolution 5223, a Resolution of Intent of the Bozeman City Commission to Change the Street Name of Dead Mans Gulch to Cattail Street MEETING DATE:December 22, 2020 AGENDA ITEM TYPE:Resolution RECOMMENDATION:Proceed with the street name change process; approve Resolution of Intent (Commission Resolution 5223, attached) and direct staff to bring back a final resolution to change the street name "Dead Mans Gulch” to “Cattail Street.” STRATEGIC PLAN:4.1 Informed Conversation on Growth: Continue developing an in-depth understanding of how Bozeman is growing and changing and proactively address change in a balanced and coordinated manner. BACKGROUND:On January 9, 1975, a plat was filed for Gardner – Simmental Plaza Subdivision. As noted on the plat, “…the lands included in the road right of way shown on said plat, except as otherwise noted, were granted, donated and dedicated to the use of the public forever”. One of those roads was Dead Mans Gulch. It is being recommended to change the street name of Dead Mans Gulch to Cattail Street as it aligns with the existing portion of Cattail Street and Dead Mans Gulch is no longer a desirable street name. A medical clinic is being planned on this street, and the developer of the clinic prefers not to have the name of the road "Dead Mans Gulch. This change will provide consistency with our street network and follows Strategic Plan Item 3- A Safe, Welcoming Community, as well as Strategic Plan Item 4 – A Well Planned City. UNRESOLVED ISSUES:None Identified ALTERNATIVES:As suggested by the City Commission. FISCAL EFFECTS:Cost of replacing the street name markers is estimated to be $500. Attachments: Staff Report - Dead Mans Gulch Name Change Resolution 5223 intent - Dead Mans Gulch to Cattail Street Map of Proposed Change 1 Notice of Intent Owner Excel Spreadsheet Report compiled on: November 24, 2020 2 CITY ENGINEERING STAFF REPORT Proposal to change the street name “Dead Mans Gulch” to “Cattail Street” Background Dead Mans Gulch is an east-west street in the City limits of Bozeman that terminates at N. 19th Avenue to the west and Simmental Way to the east. The street is one block in length and aligns with Cattail Street, which is an east-west City Street located west of N. 19th Avenue. Dead Mans Gulch is bounded to the east by Interstate 90 right-of-way. Over the past year, the City has seen a lot of interest in development adjacent to Dead Mans Gulch in the Gardner-Simmental Plaza Subdivision. Most recently, Bozeman Health has expressed interest in purchasing a property adjacent to Dead Mans Gulch for development of a future health care facility. Bozeman Health has indicated to the City that addressing a health care facility off of “Dead Mans Gulch” was problematic for their business. Bozeman Health has asked that the street name is changed and is actively working with City Engineering to facilitate this request. Impact on adjacent property Only two parcels of land are adjacent to Dead Mans Gulch. The south property currently operates as an equipment rental business. Although this property is accessed off of Dead Mans Gulch, the property is addressed off of North 19th Avenue. The proposed name change is anticipated to have negligible impact on this property. The north property is up for development and has initiated the requested street name change. Impact on Traffic & Accessibility As mentioned above, Cattail Street is an existing City Street that aligns with Dead Mans Gulch. The proposed name change will improve the consistency of Bozeman’s Street network by continuing an existing street name (Cattail Street) along a similar alignment and removing an unnecessary street name (Dead Mans Gulch). This change will not impact accessibility of the City’s street network. Impact on Fire, Police, and Other Emergency Services The City Engineering Department will notify all emergency services of the proposed name change, should it get approved. In addition, the City’s GIS Department will 3 update online and hard copy City maps to reflect this change. Impact to police, fire, and other emergency services will be negligible. Impact on Garbage Collection and Maintenance The City Engineering Department will notify our solid waste department of the street name change, should it be approved. Impact to the City’s solid waste department will be negligible. Impact on Private & Public Utilities Renaming the proposed street will have no apparent impact on private or public utilities. Alternatives to Vacation The street name could be left as “Dead Mans Gulch.” The street would continue to function as is. Recommendation Renaming “Dead Mans Gulch” to “Cattail Street” can be done without detriment to the public interest, and is the preferred alternative. Renaming the street would allow for better consistency in our street network. 4 Version April 2020 RESOLUTION 5223 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY COMMISSION TO RE-NAME DEAD MANS GULCH TO CATTAIL STREET IN THE CITY OF BOZEMAN, MONTANA. WHEREAS,it has been determined that the Road Name “Dead Mans Gulch” does not fit, and is not consistent with, the City of Bozeman addressing network and is no longer a desirable road name. WHEREAS,it appears to the City Commission, based on the staff report submitted, that the subject street can be renamed without detriment to the public interests; and WHEREAS,it appears to the City Commission to be in the best interests of the City of Bozeman, and the inhabitants therein, that said Dead Mans Gulch be re-named Cattail Street. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana, to wit: It is hereby declared to be the intention of the City Commission of the City of Bozeman, Montana, to re-name Dead Mans Gulch to Cattail Street, said street being located between: Lot 1, Tract 3 and Lot 2, Tract 3 of Gardner-Simmental Plaza Subdivision as shown on the attached Exhibit A. That the Clerk of the Commission of the City of Bozeman is hereby directed to publish notice in Bozeman Daily Chronicle per Section 7-1-4127, Montana Code Annotated, and mail notice to the affected property owners, which notice shall state the time and place at which objections will be heard. On January 5, 2021, at 6:00 p.m., in the Commission Room of City Hall, 121 N Rouse Ave, Bozeman, Montana, the City Commission of the City of Bozeman will conduct a public 5 Version April 2020 hearing regarding the re-naming of Dead Mans Gulch to Cattail Street. This is the time that the Commission will hear all objections to the re-naming of said street. Written protests against the re-naming of Dead Mans Gulch to Cattail Street may be filed by an owner of real property who would be affected by the change. Such protests must be delivered to the City Clerk at the City Hall, 121 N Rouse Ave, Ste 200, Bozeman, MT not later than 5:00 p.m., M.T., on Monday, January 4, 2021. Further information regarding the proposed change, or other matters in respect thereof, may be obtained from the City Engineer, PO Box 1230, Bozeman, MT 59771, or by telephone at (406)582-2280. You are receiving this notice because you are considered an owner of realproperty within the area affected by the street name change. NOTICE IS FURTHER GIVEN that a complete copy of said Resolution 5223 is on file in the office of the City Clerk, 121 N Rouse Ave., Ste 200, Bozeman, Montana, and is subject to inspection of all persons interested.
