SUBJECT: Appointment to the Police Commission
MEETING DATE: December 1, 2020

RECOMMENDED MOTION: I move to approve the City Manager’s appointment of Courtney Smith to the
Police Commission to a term ending April 30, 2023.
BACKGROUND: The Police Commission currently has one position with an expired term as of April 30,
2020. One term renewal application and four new applications have been received. One applicant was
deemed ineligible for appointment.
The Police Commission is created under Section 7-32-4151, Montana Code Annotated. The three-
member board is appointed by the City Manager, with the concurrence of the City Commission, and is
comprised of those who are “residents of such city or town who shall have the qualifications required
by law to hold a municipal office therein."
Members are appointed to staggered three-year terms. Under Section 7-32-4152, M.C.A., one member
must be appointed annually at the first regular meeting of the City Commission in May.
Section 7-32-4154, MCA describes the role of police commission in examination of applicants for police
force; and, Section 7-32-4155, MCA describes the role of police commission in hearing and deciding
appeals brought by police officers.
The Police Commission conducts hearings and decides on appeals brought by any member of the Police
Department who has been disciplined, suspended, removed, or discharged.
This board currently has one available position. The City Clerk’s Office has received four qualifying
applications, with their relevant qualifications indicated below.

I am a law school graduate with experience practicing both criminal and civil law in Arkansas. I relocated to
Bozeman, MT and have lived in the community for almost 1 year.
Currently, I am the Criminal Justice Initiative Lead with The Montana Racial Equity Project (MTREP). In my
role, I serve Bozeman by advocating for racial equity and justice with a very inclusive lens by focusing on
policing, prosecution, and post-conviction issues. I am interested in bringing my experience and knowledge
to this Citizen Advisory Board in order to serve my community.

As a member of the Citizen Advisory Board, I would bring my legal knowledge and experience to respond to
the needs of the community.
I provided my business address as my "Physical Address" rather than list my home address. I recognize that
this application is a matter of public record, however, I, and MTREP have been a target of white nationalists
in Montana so we have always kept our physical address(es) on a need-to-know basis. The Bozeman Police
Dept knows we are at risk and is aware of our vulnerability. I ask for a critical security exception to
publishing the "Physical Address" listed. Please redact it in the public record.
