SUBJECT: Supplemental Staff Memorandum –Final adoption of Ordinance No.
2055 Creating the Pole Yard Urban Renewal District and Adopting the Revised Pole Yard
Urban Renewal District Plan with a Tax Increment Financing Provision.

RECOMMENDED MOTION:
Having considered public comment, I move to approve final adoption of
Ordinance 2055, Creating the Pole Yard Urban Renewal District and Adopting the
Revised Pole Yard Urban Renewal District Plan with a Tax Increment Financing Provision
and amend Ordinance 2055 and the Plan as stated in the Staff Memorandum dated
November 23, 2020 to recognize the Commission’s adoption of the Bozeman Community
Plan 2020 on November 17, 2020 and finding that the creation of the District and the
Revised Plan is in conformance with the newly adopted Bozeman Community Plan 2020.
BACKGROUND:
On August 17, 2020, the City Planning Board forwarded their positive
recommendation on an update to the 2009 growth policy to the City Commission. The
Planning Board reviewed the Pole Yard Urban Renewal District Plan on October 5, 2020
and recommended favorably. The Pole Yard Urban Renewal District Plan was scheduled
for provisional adoption on October 27, 2020 and for final adoption on November 10,
2020. Due to a newspaper publication noticing error, the hearing on provisional
adoption was re-noticed and delayed until November 10, 2020, and final adoption was
delayed until November 24, 2020.
The City Commission adopted a new growth policy, the Bozeman Community
Plan 2020, on November 17, 2020 with an effective date of November 19, 2020. The
Bozeman Community Plan 2020 shares similar priorities and goals with the 2009 growth
policy, and no conflicts between the documents applicable to the Pole Yard Urban
Renewal District Plan have been identified. Therefore, analysis by staff and the Planning
Board for compliance with the Bozeman Community Plan (2009) remains valid.
RECOMMENDED AMENDMENTS:
Based on the adoption of the Bozeman Community Plan 2020, staff recommend the
following changes to Ordinance 2055 and the Pole Yard Urban renewal District Plan:
1. Add the following recitals to Ordinance 2055, immediately after the 11th recital:
WHEREAS, on November 17, 2020 the City Commission adopted the Bozeman
Community Plan 2020, with an effective date of November 19, 2020; and
WHEREAS, having reviewed the Planning Board’s recommendation and the new
growth policy, the City Commission finds no conflicts relevant to the Pole Yard Urban
Renewal District between the Bozeman Community Plan adopted in 2009 and the
Bozeman Community Plan 2020; and
2. Revise page 3 of the Pole Yard Urban Renewal Plan as follows:
Finally, this effort also reflects the goals presented in the March 2020 Draft
Bozeman Community Plan 2020, which is being prepared adopted on November
17, 2020 in accordance with § 76-1-601 MCA, the state’s Growth Policy Statute.
The draft Bozeman Community Plan 2020 sets forth a series of goals, grouped by
theme. Of particular note to this examination are the following themes and
associated goals:
Theme 1 2. “A City of Unique Neighborhoods”
Support well-planned, walkable neighborhoods.
Pursue simultaneous emergence of commercial nodes and
residential development through diverse mechanisms in
appropriate locations.
Theme 2 3. “A City Bolstered by Downtown and Complementary Districts”
Support urban development within the City.
Encourage growth throughout the City, while increasing a pattern
of community development oriented on centers of employment
and activity. Support a gradual increase in intensity within
developed areas.
Theme 5 6. “A city powered by its creative, innovative and entrepreneurial
economy”
Promote the continued development of Bozeman as an innovative
and thriving economic center.
Survey and revise land use planning and regulations to promote
and support economic diversification efforts. (City of Bozeman,
2020)
3. Revise page 27 of the Pole Yard Urban Renewal Plan, third full paragraph, as
follows:
The Bozeman Community Plan was duly adopted as the current growth
policy by the Bozeman City Commission by City of Bozeman Resolution No. 4163,
dated June 1, 2009. The City of Bozeman is currently in the process of updating
and rewriting the growth policy. On August 17, 2020, the City Planning Board
forwarded their positive recommendation on the draft an update to the growth
policy to the City Commission. The Planning Board reviewed the Pole Yard Urban
Renewal District Plan on October 5, 2020 and recommended favorably, finding
the Plan to be in compliance with the 2009 growth policy. The Pole Yard Urban
Renewal District Plan was scheduled for final adoption on November 10, 2020
but due to a noticing error, final action was delayed until November 24, 2020.
The City Commission adopted a new growth policy, the Bozeman Community
Plan 2020, on November 17, 2020 with an effective date of November 19, 2020.
The two community plans share similar priorities and goals and there are no
conflicts between the documents applicable to the Pole Yard Urban Renewal
District Plan. As this new version of the growth policy will not be adopted by the
City Commission prior to the end of 2020, the Pole Yard Urban Renewal District
Plan has been reviewed under the 2009 Bozeman Community Plan.
