This section of the submittal meets the requirements of BMC 38.220.A.15. The applicant has initiated discussions with Brian Heaston, Senior Engineer, City of Bozeman
relating to existing water rights associated with the property and how they can be used to satisfy Section 38.410.130 Bozeman Municipal Code. A preliminary analysis shows a historic consumptive volume of 142 AF with an anticipated water demand of 152 AF. The water rights have an irrigation purpose so a Change Authorization is needed from DNRC to use them for municipal purposes. At this time the applicant is planning to pursue the Change Authorization and transfer the water rights to the City to meet the requirements of Section 38.410.130. The applicant will request that the transfer of water rights be deferred by phase as Northwest Crossing develops. Any balance remaining following the transfer will be satisfied by a payment- in-lieu.
