The parcel was originally developed as, and remains, a small commercial office building, as was discussed at the November 10, 2020 City Commission public hearing for the R-O (Residential-Office District) Zone Map Amendment (ZMA) for this property (File No. 20-102). As shown in the attached Exhibits, the property owner has been seeking consideration since Spring 2020 of a request to designate this parcel as Commercial Emphasis Mixed Use on the proposed Future Land Use Map (FLUM). Due to an incomplete public record following the outbreak of the COVID-19 pandemic, it is unclear whether this proposal (Exhibit A) was previously considered by the Planning Board. These comments were included in the February 4, 2020 agenda (Exhibit B), however, as it cannot be definitively demonstrated that the Planning Board considered nor formally authorized the owner’s proposal, we are resubmitting this request for consideration by the City Commission prior to adoption of the Bozeman Community Plan. During the November 10, 2020 City Commission hearing for the ZMA, it was discussed how this proposed FLUM map change had been anticipated to resolve all non-conformities for this parcel. This request is therefore a continuation of the minor housekeeping approved through the ZMA by the City Commission for this parcel and coincides succinctly with the Commission’s review of the Bozeman Community Plan. Moreover, this request represents sound community planning that anticipates future permitted use irregularities that might occur if the parcel is designated as Urban Residential (as is shown in the draft FLUM map) and the existing offices were redeveloped, as an office developed in the R-O Zoning District under Residential FLUM map category is limited the amount of building area that can be allocated for office space. In closing, this request offers an opportunity to address this minor housekeeping matter with the formal adoption of the Community Plan, thus allowing the property owner to fully utilize this property in a legally conforming manner.
